Pursuant to Public Notice CRTC 1993-14 dated 24 February 1993, the Commission renews the Class 1 licence held by Maclean Hunter Limited (Maclean Hunter), for the cable distribution undertaking serving Thunder Bay, from 1 September 1993 to 31 August 2000. The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions in effect under the current licence, as well as to those conditions specified in this decision and in the licence to be issued.

In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to continue to distribute, at its option, the signals of WXYZ-TV (ABC), WJBK-TV (CBS), WTVS (PBS) and WDIV (NBC) Detroit, Michigan, received via satellite from the CANCOM network, as part of the basic service.

Consistent with Decision CRTC 88-710 dated 30 September 1988, by condition of licence, the licensee is relieved of the requirement of section 9 of the regulations that it distribute the French-language educational television programming service operated by TVOntario ("La Chaîne française"), on the basic band (channels 2 to 13), so long as the service is distributed as part of the basic service. With respect to the carriage of the distant signal of CHCH-TV Hamilton, the Commission has determined that, pursuant to a condition of Maclean Hunter's licence, the licensee is henceforth prohibited from distributing this signal. In making this determination, the Commission has taken into account the intervention submitted by Thunder Bay Electronics Limited, licensee of Thunder Bay television stations CKPR-TV and CHFD-TV, claiming that it is being prejudiced by the distribution of CHCH-TV. The Commission has also considered Maclean-Hunter's response to this intervention.

The Commission considers that, in light of its policy statement contained in Public Notice CRTC 1993-74 dated 3 June 1993, distribution of CHCH-TV on this undertaking should take place only upon the licensee obtaining the Commission's approval following a public process. Should the licensee wish to distribute this service in the future, it will be required to submit an application which takes into account the criteria set out in Public Notice CRTC 1993-74.

The Commission reaffirms the particular importance it attaches to the development of community programming and has taken note of the annual budgets that will be allocated for this purpose during the new licence term. The Commission encourages the licensee to continue its efforts to develop community programs that reflect subscriber interests and concerns.

In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. It encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources. The Commission notes the intervention to this application submitted by Robert T. Sare of Thunder Bay, expressing concern with the poor reception of a specific audio channel, and is satisfied with the licensee's response to the concerns raised.
