New campus radio station
Following a Public Hearing in the National Capital Region held on 20 April 1993, the Commission approves the application for a broadcasting licence for an English-language campus instructional radio programming undertaking at Victoria, on the frequency 103.1 MHz (channel 276), with an effective radiated power of 50 watts.
The Commission will issue a licence expiring 31 August 1999, for a campus instructional radio station. This licence will be subject to the conditions specified in this decision and in the licence to be issued.
In Public Notice CRTC 1992-38 dated 29 May 1992 entitled "Policies for Community and Campus Radio", campus stations are defined as those owned or controlled by a not-for-profit organization associated with a post-secondary educational institution. Additionally, a campus instructional station has the training of professional broadcasters as its primary objective.
The new station will be the third campus instructional station in Canada. The first such FM station licensed by the Commission is CIXX-FM, operated since 1978 by the students of Fanshawe College in London, Ontario. The other is CJLX-FM, licensed in 1990 for the students of Loyalist College in Belleville, Ontario. The Commission expects instructional radio to provide alternative programming to their audiences as well as providing a training ground for broadcasters. Alternative programming should include music, especially Canadian music, not generally heard on commercial stations (including traditional and special interest music, as well as styles of popular music seldom broadcast), in-depth spoken word programming, and some formal educational programming. All campus stations should provide programming that is complementary, not only to that of commercial stations, but also to that of community stations and other campus stations operating in the same location.
With the approval of this application, the Victoria area will gain a second campus FM station, the other being CFUV-FM, a campus community FM station operated by the University of Victoria. The new FM station will differ from CFUV-FM in that it will be staffed for the most part by students training for media careers, and whose participation forms part of that training. There will be a more pronounced emphasis on news and instructional programming, and the new station will not rely on fund-raising drives. The Commission notes that an intervention in support of this application was submitted by CFUV-FM.
The applicant proposes 30 hours of weekly programming, including a commitment to devote at least 10 hours to spoken word each week. Specific programs proposed also include a daily program featuring local, regional and national artists whose music is not generally heard on commercial radio, a weekly program devoted to the students and staff of the Victoria Conservatory of Music, and a weekly reading program directed to the visually impaired. The Commission considers as noteworthy that the new station has made a commitment to a weekly level of 45% Canadian content in its popular music programming. The Commission further notes the applicant's undertaking to pursue the recruitment and training of volunteers from the community at large as well as from the general student body of Camosun College.
The Commission announced in Public Notice 1993-38 dated 19 April 1993 a revision of its policy regarding advertising on campus stations. Because of the licensee's plans to broadcast only 30 hours per week, the Commission authorizes it, by condition of licence, to broadcast a maximum of 120 minutes of advertising per broadcast week, with a maximum of four minutes in any one hour. Of this weekly total, a maximum of 30 minutes of conventional advertising will be permitted. All other advertising broadcast must conform to the following definition:
 ...simple statements of sponsorship that identify the sponsors of a program or of the station. Such statements may incorporate the names of the sponsor, the business address, hours of business, and a brief general description of services or products that the sponsor provides, including the price, name and brand name of the product. Such statements must not contain references to convenience, durability and desirability or contain other comparative or competitive references.
With regard to the hours of broadcast, and as outlined in Public Notice CRTC 1992-38, campus stations may reduce or increase their hours of broadcast by up to 20% without application to the Commission, provided they meet the minimum percentage commitments set out in their Promises of Performance. The licensee is reminded that any increase or decrease to the hours of broadcast beyond the 20% level requires authorization by the Commission. It is a condition of licence that the licensee retain full control over all decisions concerning the management and programming of this station and that the majority of directors be students. In addition, the Commission reminds the licensee that, in accordance with the requirements of the "Direction to the CRTC (Ineligibility to Hold Broadcasting Licences)", the chairman or other presiding officer and each of the directors or other similar officers of the licensee must be Canadian citizens.
It is a condition of licence that construction of this undertaking be completed and that it be in operation within twelve months of the date of this decision or, where the applicant applies to the Commission within this period and satisfies the Commission that it cannot complete implementation before the expiry of this period and that an extension is in the public interest, within such further period of time as is approved in writing by the Commission.
The Commission notes the numerous interventions submitted in support of this application, including those from commercial broadcasters operating in the Victoria market.
