Following a Public Hearing in the National Capital Region held on 24 November 1992, the Commission approves the application for a broadcasting licence for a Montagnais- and French-language FM radio programming undertaking at Maliotenam, on the frequency 104.5 MHz (channel 283), with an effective radiated power of 50 watts, and a transmitter at Sept-Iles, on the frequency 90.1 MHz (channel 211), with an effective radiated power of 0.6 watts.
Pursuant to Public Notice CRTC 1990-89 dated 20 September 1990 entitled Native Broadcasting Policy, the Commission will issue a licence for a Type B FM native radio station. This licence will expire on 31 August 1999, and will be subject to the conditions specified in this decision and in the licence to be issued.
The Commission notes that the Corporation de radio Kushapetsheken Apetuamiss Uashat will broadcast 109 hours per week of programming of which 96 hours and 30 minutes will be local programming and 12 hours and 30 minutes will originate from the Société de communication Attikamekw Montagnais (SOCAM) network. Of the local programming, 92 hours and 30 minutes will be in Montagnais and 4 hours will be in French. The applicant is reminded of the amendments to the Radio Regulations, 1986, which set out requirements for a minimum level of Spoken Word programming and Canadian musical selections.
It is a condition of licence that the applicant broadcast no more than an average of 4 minutes of advertising per hour per day, with a maximum of 6 minutes in any given hour, in accordance with the native radio policy for Type B stations.
It is a condition of licence that the applicant adhere to the guidelines on sex-role portrayal set out in the Canadian Association of Broadcasters' (CAB) Sex-Role Portrayal Code for Television and Radio Programming, as amended from time to time and approved by the Commission.
It is also a condition of licence that the licensee adhere to the provisions of the CAB's Broadcast Code for Advertising to Children, as amended from time to time and approved by the Commission.
The Department of Communications (DOC) has advised the Commission that this application is conditionally technically acceptable, and that a Broadcasting Certificate will only be issued once it has been determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.
In accordance with subsection 22(1) of the Broadcasting Act, the Commission will only issue the licence, and the authority granted herein may only be implemented, at such time as written notification is received from the DOC that its technical requirements have been met, and that a Broadcasting Certificate will be issued.
