I. Application 910829100
 Public Notice CRTC 1991-87
Pursuant to Public Notice CRTC 1991-87 dated 23 August 1991, the Commission renews the broadcasting licence for the radio programming undertaking consisting of CHON-FM Whitehorse and its transmitters, from 1 March 1992 to 31 March 1999, subject to the conditions specified in this decision and in the licence to be issued.
CHON-FM will broadcast 84 hours per week of local programming, of which 13.5 hours will be in seven Yukon aboriginal languages, and 70.5 hours will be in English.
The Commission acknowledges the important role played by Northern Native Broadcasting, Yukon (NNBY) in meeting the linguistic and cultural needs of the native population of the Yukon Territory through the operation of CHON-FM and its transmitters. The Commission notes that this station is owned and controlled by a not-for-profit organization whose structure provides for membership, management, operation, and programming primarily by members of the community at large.
The Commission also notes that CHON-FM is a Type B FM native radio station in accordance with Public Notice CRTC 1990-89 dated 20 September 1990, entitled Native Broadcasting Policy.
The licensee is reminded of the recently implemented amendments to the Radio Regulations, 1986, which set out requirements for a minimum level of Spoken Word programming and Canadian musical selections.
It is a condition of licence that the licensee broadcast no more than an average of 4 minutes of advertising per hour per day, with a maximum of 6 minutes in any given hour, in accordance with the native radio policy for Type B stations.
It is a condition of licence that the licensee adhere to the guidelines on sex-role portrayal set out in the Canadian Association of Broadcasters' (CAB) Sex-Role Portrayal Code for Television and Radio Programming, as amended from time to time and approved by the Commission.
It is also a condition of licence that the licensee adhere to the provisions of the CAB's Broadcast Code for Advertising to Children, as amended from time to time and approved by the Commission. The Commission notes that CHON-FM provides all of the programming currently broadcast by NNBY's radio network. Consistent with the procedures outlined in Public Notice CRTC 1991-63 entitled "New Broadcasting Act - Amendments to Classes of Licence", the Commission has issued a licence for a radio programming undertaking for CHON-FM and its transmitters and has therefore determined that NNYB no longer requires a licence to operate a radio network. Accordingly, no further action is required on application 910830900 announced in Public Notice CRTC 1991-87 for the renewal of the broadcasting licence for NNYB's radio network, expiring 28 February 1992.

At a Public Hearing in Vancouver beginning on 29 October 1991, the Commission also considered applications by NNBY for licences to carry on radiocommunication distribution undertakings at Destruction Bay, Haines Junction and Mayo Road Subdivision, Whitehorse, to rebroadcast the programs of CHON-FM.
Consistent with the procedures outlined in Public Notice CRTC 1991-63, the Commission approves the applications and amends the broadcasting licence of CHON-FM (the originating station), by authorizing the licensee to add transmitters at Destruction Bay, Haines Junction and Mayo Road Subdivision, Whitehorse.
Each transmitter will operate with an effective radiated power of 10 watts and with the following technical parameters:

This approval is subject to the requirement that construction of the transmitting facilities be completed and that they be in operation within twelve months of the date of this decision or, where the licensee applies to the Commission and satisfies the Commission that it cannot complete implementation before the expiry of this period and that an extension is in the public interest, within such further periods of time as may be approved in writing by the Commission.
Should the Commission refuse to approve an extension of time requested by the licensee, the authority granted shall lapse and become null and void upon the termination of the last approved extension period.
III. Revocation of the licence held by The Shakwak Valley Community Club
The Shakwak Valley Community Club has requested the revocation of its licence for CHHJ-FM Haines Junction. As approved herein, NNBY will now provide an FM radio service to Haines Junction through its transmitter, which will rebroadcast the programs of CHON-FM. In view of the licensee's request and pursuant to paragraph 9(1)(e) and subsection 24(1) of the Broadcasting Act, the Commission hereby revokes the licence issued to Shakwak Valley Community Club.
