Following a Public Hearing in the National Capital Region beginning on 8 July 1991, the Commission approves the application for a broadcasting licence for a predominantly English- language radio programming undertaking at Ohsweken on the FM frequency 100.3 MHz, channel 262, with an effective radiated power of 250 watts. The applicant will also offer 8 hours per week of Native-language programming.
The licence will expire on 31 August 1994, and will be subject to the conditions specified in this decision and in the licence to be issued. This term will enable the Commission to consider the renewal of this licence at the same time as that of other undertakings in the area.
Pursuant to Public Notice CRTC 1990-89 dated 20 September 1990 entitled Native Broadcasting Policy, the Commission will issue a licence for a Type B FM native radio station. The applicant is reminded of the recently implemented amendments to the Radio Regulations, 1986, which require the provision of a 15% minimum level of Spoken Word programming per week and that at least 30% of all musical selections broadcast each week be Canadian. It is a condition of licence that the applicant broadcast no more than an average of 4 minutes of advertising per hour per day, with a maximum of 6 minutes in any given hour, also in accordance with the native radio policy for Type B stations.
It is a condition of licence that construction of this undertaking be completed and that it be in operation within twelve months of the date of this decision or, where the applicant applies to the Commission within this period and satisfies the Commission that it cannot complete implementation before the expiry of this period and that an extension is in the public interest, within such further period of time as is approved in writing by the Commission.
It is a condition of licence that the applicant adhere to the guidelines on sex-role portrayal set out in the Canadian Association of Broadcasters' (CAB) Sex-Role Portrayal Code for Television and Radio Programming, as amended from time to time and approved by the Commission.
It is also a condition of licence that the applicant adhere to the provisions of the CAB's Broadcast Code for Advertising to Children, as amended from time to time and approved by the Commission.
The Commission acknowledges the intervention to this application received from Concerned Members of the Six Nations Community, and is satisfied with the applicant's reply to the concerns raised. The Commission also notes the intervention by the Six Nations Council in support of the application.
