At a Public Hearing in the National Capital Region beginning on 8 July 1991, the Commission considered an application by Radio Gaspésie Inc. for authority to carry on a French-language FM radio broadcasting transmitting undertaking at Murdochville to rebroadcast the programs of CJRG-FM Gaspé.
In accordance with Public Notice CRTC 1991-63 entitled New Broadcasting Act - Amendments to Classes of Licence, the Commission approves the application and amends the licence of CJRG-FM, the originating station, by authorizing the licensee to establish a radiocommunication distribution undertaking at Murdochville.
Radio-Gaspésie Inc. proposed to use the frequency of 99.5 MHz (channel 258A) and an effective radiated power of 62.1 watts as technical parameters for the proposed service at Murdochville. As the CBC noted in its intervention, however, use of this frequency is contemplated under the Corporation's revised Long Range Radio Plan, for the broadcast of its French-language radio (monophonic) service at Murdochville, submitted to the Commission in January 1989. In its response to that intervention, the applicant noted that the frequencies of 92.1 MHz (channel 221) and 104.7 MHz (channel 284), would also be available if it is unable to use the proposed frequency.
Consequently, although the Commission approves the application by Radio Gaspésie Inc., it does not approve the proposed technical parameters. The applicant must submit to the Commission, within three months of the date of this decision, an application to use other technical parameters for the operation of the proposed FM station. In addition, the applicant must obtain confirmation from the Department of Communications (DOC) that the revised parameters it chooses are technically acceptable and that the DOC will issue a Broadcasting Certificate.
In accordance with subsection 22(1) of the Broadcasting Act, the Commission will only issue the licence amendment, and the authority granted herein may only be implemented, at such time as written notification is received from the DOC that its technical requirements have been met, and that a Broadcasting Certificate will be issued.
This approval is subject to the requirement that construction of this undertaking be completed and that it be in operation within twelve months of the date of receipt of the DOC notification referred to in the preceding paragraph or, where the applicant applies to the Commission within this period and satisfies the Commission that it cannot complete implementation before the expiry of this period and that an extension is in the public interest, within such further period of time as is approved in writing by the Commission. Should the Commission refuse to approve an extension of time requested by the licensee, the authority granted shall lapse and become null and void upon the termination of the last approved extension period.
The Commission notes the written interventions submitted by the city of Murdochville and by the Club de l'Âge d'Or les Montagnards de Murdochville in support of this application.
