Following a Public Hearing in the National Capital Region on 27 June 1989, the Commission approves the application for a licence for a French-language FM radio broadcasting transmitting undertaking at Amos/Val d'Or, on the frequency 91.5 MHz, channel 218B, with an effective radiated power of 34,400 watts to rebroadcast the programs of the new FM radio station at Rouyn/ Noranda authorized in Decision CRTC 89-682 of today's date.

The Commission will issue a special FM licence expiring 31 August 1994, subject to the conditions specified in this decision and in the licence to be issued.
Communications Cuivor Inc., licensee of CJMM-FM Rouyn-Noranda and CJMV-FM Ville-Marie, filed an intervention opposing the establishment of new radio stations in the Abitibi/ Témiscamingue market. It pointed out that this is a fragile market and [TRANSLATION] "should not be subjected to the repercussions that would result from the introduction of new undertakings until the existing stations have achieved some measure of equilibrium". It added that the Commission should require that Radio Nord Inc. file a copy of its agreement with the CBC relating to the carriage of CBC programs by the new stations in Rouyn-Noranda and Amos/Val-d'Or. In reply, Radio Nord Inc. explained that the applications to disaffiliate CHLM-MF Rouyn-Noranda from the CBC's French-language AM radio network and to operate new stations that would rebroadcast programs received from that network were filed in response to Public Notice CRTC 1988-130 relating to the improvement of radio service in the Abitibi/Témiscamingue region. The licensee also pointed out that approval of these applications would enable it to regularize the situation with respect to frequency utilization and to provide residents of the Abitibi/ Témiscamingue area with the kind of homogeneous and consistent programming that is offered by stations operating in the Group I music format. It added that a copy of its agreement with the CBC had been filed with the Commission.

The Department of Communications (DOC) has advised the Commission that this proposal is technically acceptable, but that issuance of a Technical Construction and Operating Certificate is conditional upon the resolution of any problems involving interference with aeronautical NAV/COM services.

In accordance with paragraph 13(1)(b) of the Broadcasting Act, the Commission will only issue the licence, and the authority granted herein may only be implemented, at such time as written notification is received from the DOC that it will issue a Technical Construction and Operating Certificate.

It is a condition of licence that the authority granted herein be implemented within twelve months of the date of receipt of written notification from the DOC that it will issue a Technical Construction and Operating Certificate or, where the applicant applies to the Commission and satisfies the Commission that it cannot implement its authority before the expiry of this period and that an extension is in the public interest, within such further period of time as is approved in writing by the Commission.
