CRTC staff has issued a notice of violation to the following persons with regard to the application of the Unsolicited Telecommunications Rules or Canada’s Anti-Spam Law

A CRTC investigation found that telemarketing telecommunications were made on behalf of Kevin Carmichael to telephone numbers registered on the National Do Not Call List (DNCL) during periods when Kevin Carmichael was neither registered nor subscribed to the National DNCL. In addition to paying an AMP, Kevin Carmichael has agreed to implement a compliance program.
December 12, 2019 Unconquered Sun Solar Technologies Inc. Unconquered Sun Solar Technologies Inc. has paid an Administrative Monetary Penalty (AMP) of $18,000 as part of a settlement over violations of Part II, section 4, Part II, section 6 and Part III, section 23 of the Unsolicited Telecommunications Rules. Unconquered Sun Solar Technologies Inc. to telephone numbers registered on the National Do Not Call List (DNCL) and during periods when Unconquered Sun Solar Technologies Inc. failed to purchase a subscription to the National DNCL. Telemarketing telecommunications were also made by Unconquered Sun Solar Technologies Inc. outside of the permissible calling hours.
December 12, 2019 John Paul Revesz and Vincent Leo Griebel, partners, Orcus Technologies The Chief Compliance and Enforcement Officer has issued notices of violation to John Paul Revesz and Vincent Leo Griebel, partners in Orcus Technologies, alleging that each has committed a violation of Section 9 of Canada’s Anti-Spam Legislation.
December 10, 2019 Central Realty Ltd. Central Realty Ltd. has paid an Administrative Monetary Penalty (AMP) of $6,000 as part of a settlement over violations of Part II, sections 4 & 7 and Part III, section 3 of the Unsolicited Telecommunications Rules. A CRTC investigation found that telemarketing telecommunications were made on behalf of Central Realty Ltd. to telephone numbers registered on the National Do Not Call List (DNCL) during periods when Central Realty Ltd. was neither registered nor subscribed to the National DNCL. In addition to paying an AMP, Central Realty Ltd. confirmed that it has in place a compliance program.
November 29, 2019 Warren Schatz Warren Schatz has paid an Administrative Monetary Penalty (AMP) of $3,500 as part of a settlement over violations of Part II, sections 4 & 7 and Part III, section 3 of the Unsolicited Telecommunications Rules. A CRTC investigation found that telemarketing telecommunications were made on behalf of Warren Schatz to telephone numbers registered on the National Do Not Call List (DNCL) during periods when Warren Schatz was neither registered nor subscribed to the National DNCL. In addition to paying an AMP, Warren Schatz has agreed to implement a compliance program before engaging in any further telemarketing..
November 25, 2019 Camosun Properties Ltd. Camosun Properties Ltd. has paid an Administrative Monetary Penalty (AMP) of $5,500 as part of a settlement over violations of Part II, sections 4 & 7 and Part III, section 3 of the Unsolicited Telecommunications Rules. A CRTC investigation found that telemarketing telecommunications were made on behalf of Camosun Properties Ltd. to telephone numbers registered on the National Do Not Call List (DNCL) during periods when Camosun Properties Ltd. was neither registered nor subscribed to the DNCL. In addition to paying an AMP, Camosun Properties Ltd. has agreed to implement a compliance program.

In addition to paying an AMP, Kerstin Munk has agreed to implement a compliance program if she initiates telemarketing telecommunications or authorizes a third party to initiate telemarketing telecommunications on her behalf.

In addition to paying an AMP, Daniel Deng has agreed to implement a compliance program if he initiates telemarketing telecommunications or authorizes a third party to initiate telemarketing telecommunications on his behalf.

A CRTC investigation found that telemarketing telecommunications were made on behalf of an agent of Westmar Realty Ltd. to telephone numbers registered on the National Do Not Call List (DNCL) during periods when Westmar Realty Ltd. was neither registered nor subscribed to the National DNCL. In addition to paying an AMP, Westmar Realty Ltd. has agreed to revise its compliance program.

Keller Williams Golden Triangle Realty Inc. has paid an Administrative Monetary Penalty (AMP) of $10,000 as part of a settlement over violations of Part II, sections 4 & 13 of the Unsolicited Telecommunications Rules. A CRTC investigation found that telemarketing telecommunications were made on behalf of Keller Williams Golden Triangle Realty Inc. to telephone numbers registered on the National Do Not Call List (DNCL) and that Keller Williams Golden Triangle Realty Inc. used a version of the National DNCL obtained from the National DNCL operator that was older than thirty-one (31) days. In addition to paying an AMP, Keller Williams Golden Triangle Realty Inc. has agreed to implement a compliance program.

A CRTC investigation found that telemarketing telecommunications were made on behalf of Groupe Réno Habitat Inc. to telephone numbers registered on the National Do Not Call List (DNCL) and during periods when Groupe Réno Habitat Inc. did not have a valid subscription to the National DNCL. In addition to paying an AMP, Groupe Réno Habitat Inc. has agreed to implement a compliance program.
May 17, 2019 York Home Comfort Inc York Home Comfort Inc. has paid an Administrative Monetary Penalty (AMP) of $6,000 as part of a settlement over violations of Part II, section 4 and 6 of the Unsolicited Telecommunications Rules. A CRTC investigation found that telemarketing telecommunications were initiated by York Home Comfort Inc. during periods when York Home Comfort Inc. was not a registered subscriber of the to the National Do Not Call List (DNCL). York Home Comfort Inc. also initiated telemarketing telecommunications to consumer’s telecommunications numbers that were on the National DNCL, without express consent from those consumers. In addition to paying an AMP, York Home Comfort Inc. has agreed to implement a compliance program.

Industrielle Alliance, Assurance et services financiers inc. has paid an Administrative Monetary Penalty (AMP) of $43,500 as part of a settlement over violations of Part II, section 4 of the Unsolicited Telecommunications Rules. A CRTC investigation found that telemarketing telecommunications were made by Industrielle Alliance, Assurance et services financiers inc., or by independent insurance agents acting on its behalf, to telephone numbers registered on the National Do Not Call List (DNCL). In addition to paying an AMP, Industrielle Alliance, Assurance et services financiers inc. has agreed to update its compliance program.

ProTech Systèmes Services Québec Inc. has paid an Administrative Monetary Penalty (AMP) of $10,000 as part of a settlement over violations of Part II, section 4 & 6 of the Unsolicited Telecommunications Rules. A CRTC investigation found that telemarketing telecommunications were made by ProTech Systèmes Services Québec Inc. to telephone numbers registered on the National Do Not Call List (DNCL) and during periods when ProTech Systèmes Services Québec Inc. did not have a valid subscription to the National DNCL. DZ Climatisation Inc. has paid an Administrative Monetary Penalty (AMP) of $15,000 as part of a settlement over violations of Part II, section 7, and Part III, section 3 of the Unsolicited Telecommunications Rules. A CRTC investigation found that telemarketing telecommunications were initiated on behalf of DZ Climatisation during a time when they did not have a valid registration or subscription with the National Do Not Call Operator. In addition to paying an AMP, DZ Climatisation Inc. has agreed to implement a compliance program.
