In re: Service to high-cost serving areas proceeding - Telecom Public Notice CRTC 97-42

  1. Application for costs by the Manitoba Keewatinowi Okimakanak (MKO).
  Background
  2. By letter dated 15 February 1999, MKO applied for its costs associated with its participation in the Service to high-cost serving areas proceeding - Telecom Public Notice CRTC 97-42.
  3. MKO submitted that it satisfied the criteria for an award of costs set out in section 44 of the CRTC Telecommunications Rules of Procedure (the Rules).
  4. By letter dated 2 March 1999, in response to MKO's application for costs, Bell Canada filed comments on behalf of, and with the concurrence of, BC TEL, Bell Canada, Island Telecom Inc., Maritime Tel & Tel Limited, MTS Communications Inc. (MTS), NBTel Inc. and NewTel Communications Inc. (the Companies).
  Positions of the parties
  5. MKO submitted that it satisfied the criteria for an award of costs set out in section 44 of the Rules and that the service providers who had a significant interest in the outcome of this proceeding and actively participated should be named respondents for costs.
  6. The Companies did not object to MKO's application for costs, but submitted that the costs should be apportioned among the respondents in accordance with their level of participation in the proceeding. The Companies further reserved the right to comment at the taxation phase of the cost award process.
  Commission determination
  7. The Commission considers that MKO has satisfied the criteria for an award of costs under section 44 of the Rules.
  8. The Commission determines that MTS is the appropriate respondent for costs given that MKO's participation in this proceeding focused mainly on the needs of subscribers in MTS's service territory.
  Direction as to costs
  9. The Commission approves MKO's application for costs in this proceeding.
  10. For the reasons mentioned above, the Commission directs that the award of costs to MKO be paid by MTS as sole respondent for costs.
  11. The costs awarded herein shall be subject to taxation in accordance with the Rules.
  12. It is further directed that the costs awarded herein be taxed by Annie Paré.
  13. MKO shall, within 30 days of the issuance of this Order, submit a bill of costs and affidavit of disbursements directly to the Taxing Officer, serving a copy on the respondent for costs MTS.
  14. MTS may, within two weeks of receipt of those documents, file comments directly with the Taxing Officer in response to the claim for costs, serving a copy upon MKO.
  15. MKO may, within two weeks of receipt of any comments submitted by MTS, file a reply to such comments serving a copy on MTS.
  16. All documents to be filed or served by a specific date must actually be received, and not merely sent, by that date.
