GENERAL PRINCIPLES IN SETTING RATES, TERMS AND CONDITIONS OF CALL ORIGINATOR BILLING SERVICE

Reference: 97-8648-C12-01

1. The Commission has approved, on a final basis, market trials of Call Originator Billing (COB) Service, also referred to as Calling Party Pays, for The New Brunswick Telephone Company, Limited (Telecom Orders CRTC 95-1326, 96-1340, 97-424), Bell Canada (Bell) (Telecom Orders CRTC 96-1195 and 97-692), and Maritime Tel & Tel Limited (Telecom Orders CRTC 96-1178 and 97-78). The Commission has also granted interim approval for a COB market trial for Manitoba Telecom Services Inc. (Telecom Order CRTC 97-557). In addition, BC TEL has filed an application under Tariff Notice 3608 for a nine-month market trial of Calling Party Pays service.

2. In giving interim approval to the Bell application for a market trial, the Commission stated in Telecom Order CRTC 96-1195 that if Bell or any other Stentor member company files a COB full-service tariff for approval, the Commission would expect to initiate a proceeding to examine the rates, terms and conditions for such a service.

3. In giving final approval to the Bell market trial, the Commission stated in Telecom Order CRTC 97-692 that it considered that, given the number and complexity of the issues surrounding COB that have arisen in connection with the various applications by certain telephone companies for market trials, it would be appropriate to initiate a proceeding to examine the general principles in setting the rates, terms and conditions of COB service prior to the filing of an actual application for a COB full service tariff.

4. The Commission hereby initiates a proceeding to determine the general principles to be used in setting the rates, terms and conditions of COB service.

6. Parties wishing to participate in the proceeding must notify the Commission of their intention to do so by writing to Mr. Allan J. Darling, Secretary General, CRTC, Ottawa, Ontario, K1A 0N2, fax: 819-953-0795, by 27 June 1997. The Commission will issue a complete list of parties and their mailing addresses. Parties are to indicate in the notice their Internet email address, if available. If parties do not have access to the Internet, they are to indicate in their notice whether they wish to receive disk versions of hard copy filings. The Commission will issue a complete list of parties and their mailing addresses (including Internet email addresses if available), identifying those parties who wish to receive disk versions.

7. Any person who wishes merely to file written comments in this proceeding, without receiving copies of the various submissions, may do so by writing to the Commission at the address noted in the previous paragraph, by 28 July 1997.

8. All parties may make submissions to the Commission by 14 July 1997, serving copies on all other parties. In their submissions parties should restrict their comments to the principles to be used in establishing the rates, terms and conditions of COB service.

9. Parties may address interrogatories to other parties. Any such interrogatories must be filed with the Commission and served on all parties by 28 July 1997.

10. Responses to interrogatories addressed pursuant to paragraph 7 are to be filed with the Commission and served on all parties by 10 September 1997.

11. Requests by parties for further responses to their interrogatories, specifying in each case why a response is both relevant and necessary, and requests for public disclosure of information for which confidentiality has been claimed, setting out the reasons for disclosure, must be filed with the Commission and served on relevant parties by 29 September 1997.

12. Written responses to requests for further responses to interrogatories and for public disclosure must be filed with the Commission and served on relevant parties by 14 October 1997.

13. The Commission will issue directions on further procedure when it issues its determination with respect to requests for further responses and for disclosure.

14. Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.

15. In addition to hard copy filings, parties are encouraged to file with the Commission electronic versions of their submissions in accordance with the Commission's Interim Telecom Guidelines for the Handling of Machine-Readable Files, dated 30 November 1995.
