REVOCATION OF EXEMPTION ORDER RESPECTING DIRECT-TO-HOME (DTH) SATELLITE DISTRIBUTION UNDERTAKINGS
In Public Notice CRTC 1994-111 dated 30 August 1994, the Commission published its Exemption Order Respecting Canadian Direct-to-Home (DTH) Satellite Distribution Undertakings. Following, among other things, a government policy review of DTH satellite broadcasting, the Governor in Council issued on 6 July 1995 Orders-in-Council P.C. 1995-1105 and 1995-1106 respecting policy for the licensing of DTH satellite distribution undertakings and DTH pay-per-view television programming undertakings.
In paragraph 5(b) of Order-in-Council 1995-1105, the Governor in Council directed the Commission, following the conclusion of the licensing process for new licensed DTH satellite distribution undertakings, to take all necessary and appropriate steps to ensure that no person is authorized to carry on a DTH satellite distribution undertaking by any means other than a licence.
Following the issuance today of Decisions CRTC 95-901 and CRTC 95-902 licensing two new DTH satellite distribution undertakings, the Commission has, in the appendix to this notice, revoked its Exemption Order Respecting Canadian Direct-to-Home (DTH) Satellite Distribution Undertakings contained in the appendix to Public Notice CRTC 1994-111, effective 20 March 1996..

REVOCATION OF EXEMPTION ORDER RESPECTING CANADIAN DIRECT-TO-HOME (DTH) SATELLITE DISTRIBUTION UNDERTAKINGS
WHEREAS the Commission issued on 30 August 1994, its Exemption Order Respecting Canadian Direct-to-Home (DTH) Satellite Distribution Undertakings which exempted from the requirements of Part II of the Broadcasting Act and any regulations made thereunder, those persons carrying on broadcasting undertakings of the class defined by the terms and conditions contained in the Exemption Order;
WHEREAS the Governor in Council issued on 6 July 1995 Order-in-Council 1995-1105 respecting the licensing of DTH satellite distribution undertakings and therein directed the Commission, following its licensing process for new licensed DTH satellite distribution undertakings, to take all necessary and appropriate steps to ensure no person is authorized to carry on a DTH satellite distribution undertaking by any means other than a licence; and
WHEREAS the Commission has today issued Decisions CRTC 95-901 and CRTC 95-902 licensing two new DTH satellite distribution undertakings.
THEREFORE, the Commission hereby, by order, revokes effective 20 March 1996 its Exemption Order Respecting Canadian Direct-to-Home (DTH) Satellite Distribution Undertakings, dated 30 August 1994, contained in the appendix to Public Notice CRTC 1994-111.
