Pursuant to Public Notice CRTC 1992-46 dated 9 July 1992, the Commission approves the application to amend the broadcasting licence for CJBC Toronto by decreasing the effective radiated power of its transmitter CJBC-1-FM Belleville from 25,000 watts to 18,200 watts, and by changing the frequency of CJBC-1-FM from 95.5 MHz (channel 238C1) to 94.3 MHz (channel 232B).
The applicant has stated that no loss of service is foreseen, because areas to the east and west of Belleville affected by the reduction in the coverage area are served by CJBC-5-FM Peterborough and CJBC-2-FM Kingston.
The Department of Communications (DOC) has advised the Commission that this application is conditionally technically acceptable, and that an amendment to the Broadcasting Certificate will only be issued once it has been determined that the transmitter's proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.
In accordance with subsection 22(1) of the Broadcasting Act, the Commission will only issue the licence amendment, and the authority granted herein may only be implemented, at such time as written notification is received from the DOC that its technical requirements have been met, and that an amendment to the Broadcasting Certificate will be issued. The Commission notes that the CBC was authorized in Decision CRTC 79-325 to use frequency 94.3 MHz at Belleville to rebroadcast CBL-FM Toronto; the authority for this undertaking (CBBB-FM Belleville) was never implemented due to budgetary restraint. The CBC will now surrender the licence for CBBB-FM thus freeing the frequency 94.3 MHz for use by CJBC-1-FM.
An intervention opposing this application was submitted by G.S. Broadcast Technical Services Ltd. The Commission is satisfied with the CBC's response to the concerns raised.
