Following a Public Hearing in Montreal beginning on 13 March 1990, the Commission renews the licences for the broadcasting receiving undertakings serving Sainte-Thècle and Lac-aux-Sables, held by Aurèle Groleau, doing business under the name and style of "Groleau T.V. Câble Enrg.", from 1 October 1990 to 31 August 1995. The operation of these undertakings is regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations) and the licences will be subject to the conditions specified in this decision and in the licences to be issued.
The Commission approves the licensee's requests with respect to section 23 of the regulations. Accordingly, it is a condition of each licence that the licensee be relieved of the requirement that it distribute at least four television programming services delivered to its local head end by a network operator licensed to extend television and radio services to remote and underserved communities, at least one of which must be a Canadian television programming service, so long as it distributes only one U.S. television service in Sainte-Thècle and no U.S. television service in Lac-aux-Sables.
In approving these requests, the Commission took into account the licensee's arguments that these two communities are predominantly French speaking, the subscribers did not request additional CANCOM services, the undertakings' financial situation do not enable them to carry these services and that the licensee's does not want to significantly increase its subscriber fee.
The Commission notes the intervention from Canadian Satellite Communications Inc. in this regard.
Further, an intervention has been received from TVOntario objecting to the applicant's proposal to distribute TVOntario programming ("La Chaîne française") received via satellite in Sainte-Thècle and Lac-aux-Sables. The Commission draws to the licensee's attention that, pursuant to the regulations and as set out in the list of Part III Eligible Canadian Satellite Services (Appendix to Public Notice CRTC 1989-102), the distribution of out-of-province educational services not receivable over-the-air is only authorized subject to the requirement that there be no objection on the part of the originating service. In light of TVOntario's objection, the Commission is not prepared to approve the proposed distribution of "La Chaîne française".
