Phase I – Presentation by the licensee

This item pertains to CKLN Radio Incorporated, licensee of the community-based campus radio programming undertaking CKLN-FM Toronto. The Commission has received complaints concerning the governance structure, day to day management and operations, programming and ability to remain on-air of the station, which the Commission will discuss with representatives of the licensee.

In addition, the Commission is also concerned that the station may be operating in non-compliance with the Radio Regulations, 1986 (the Regulations), with respect to the filing of complete annual returns and the provision of logger tapes and program logs requests for information, ownership and control, and that the manner in which CKLN-FM is currently being operated is inconsistent with the Commission's policies for campus-based community radio stations.

The Commission expects CKLN Radio Incorporated to show cause why the Commission should not take steps to suspend or revoke the broadcasting licence in question or why the Commission should not issue mandatory orders requiring the licensee to comply with the Regulations and its conditions of licence.

Applications by Aboriginal Voices Radio Inc. (AVR) to renew the broadcasting licences for the Native Type B radio programming undertakings CKAV-FM Toronto, CKAV-FM-2 Vancouver, CKAV-FM-3 Calgary, CKAV-FM-4 Edmonton and CKAV-FM-9 Ottawa, expiring 31 August 2010.

The Commission is concerned that these stations may be operating in non compliance with the Radio Regulations, 1986 (the Regulations) and their conditions of licence related to the minimum level of local programming.

The Commission will also discuss various issues with the licensee related to its programming orientation and its stations' funding.

The Commission expects AVR to show cause why a mandatory order requiring the licensee to comply with the Regulations and its conditions of licence should not be issued and why the Commission should not consider recourse to additional measures, such as short-term renewal, suspension, non‑renewal or revocation of the licence in question.

Application by Corus Radio Company to renew the licence of the commercial radio programming undertaking CFNY-FM Brampton, expiring 31 August 2010.

The Commission is concerned that the licensee may have failed to comply with the Radio Regulations, 1986 (the Regulations) and its condition of licence relating to its Canadian talent development (CTD) contribution for the 2009 broadcast year. Specifically, it appears that the licensee may have contribute to a non-eligible initiative for CTD funding. The funding in question relates to the Son House Productions initiative.

The Commission expects the licensee to show cause why a mandatory order should not be issued requiring the licensee to comply with the Regulations and its condition of licence relating to CTD contributions.

Application by Pellpropco Inc. to renew the broadcasting licence for the English-language commercial radio programming undertaking CHSC St. Catharines, expiring 31 August 2010.

The Commission is concerned that the station may be operating in non compliance with the Radio Regulations, 1986 (the Regulations), its conditions of licence and existing mandatory orders related to news, annual returns, requests for information and Canadian talent development contributions.

The Commission expects to clarify certain programming and technical issues related to CHSC's operation, including its programming service to the residents of St. Catharines and the Niagara region, its transmission facilities and the status of its studio facilities in the St. Catharines market.

The Commission also expects Pellpropco Inc. to show cause why a mandatory order should not be issued requiring the licensee to comply with the Regulations and its conditions of licence and why the Commission should not consider recourse to additional measures, such as short-term renewal, suspension, non-renewal or revocation of the licence in question.
