Introduction

Many television (TV) stations use the 600 MHz spectrum band to transmit their signals. However, the use of this band is now subject to a joint effort by the department of Innovation, Science and Economic Development in Canada and the Federal Communications Commission in the United States to repurpose some amount of spectrum currently used for television broadcasting for mobile services (e.g. mobile phones). The new allotment plan and transition plan may require some television stations (and rebroadcasting transmitters) to change channel (i.e., their frequency of operation) or convert to digital.

In Decision 2017-143 Renewal of licences for the television services of large French-language ownership groups – Introductory decision, 15 May 2017 and Decision 2017-148 Renewal of licences for the television services of large English language ownership groups – Introductory decision, the Commission established a new condition of licence (COL) for the large ownership groups’ stations, allowing these licensees to revise technical parameters and service contours without additional approval by the Commission.  The Commission also invited other TV licensees to apply to the Commission in order to request that the COL apply to them.  This form is to be used for any applicant requesting an amendment to its COL to add this flexibility.

2. Application

Condition of licence

As provided for in Broadcasting Decision CRTC 2017-143 - Renewals of television licences for large French-language television ownership groups – Introductory decision, 15 May 2017 and Broadcasting Decision CRTC 2017-148 - Renewals of television licences for large English-language television ownership groups – Introductory decision, 15 May 2017, the applicant hereby requests that the Commission amend the licences for each OTA television station listed in the table below by adding the following COL:

  1. The licensee is authorized to operate the television station and transmitters according to contours and technical parameters that differ from those approved in its most recent application and/or listed on its licence, to the extent that these new contours and technical parameters have been approved by the Department of Industry (the Department) as a result of the Department’s repurposing initiative of the 600 MHz frequency band as described in Decision on Repurposing the 600 MHz Band, LPB-004-15, 14 August 2015 and its April 2017 Digital Television (TV) Allotment Plan, Digital Television (TV) Transition Schedule and the Broadcasting Procedures and Rules entitled BPR-11 – Broadcasting Television Application Procedures During the 600 MHz Transition.
  2. For the purpose of the Broadcasting Distribution Regulations, the licensee is deemed to be operating the television station and transmitters under the contours and technical parameters approved by the Commission and in effect on 15 May 2017.
  3. The above authorizations are valid only if the Commission receives confirmation from the Department that the revised contours and technical parameters resulting from the Department’s repurposing initiative of the 600 MHz frequency band satisfy the requirements of the Radiocommunication Act and the regulations made thereunder, and that a broadcasting certificate has been or will be issued to the licensee in respect of the revised parameters.
