RE: Application for final costs in the proceeding initiated by Telecom Notice of Consultation CRTC 2016-192, Examination of differential pricing practices related to Internet data plans – Procedural letter

Dear Madam, Sir:

The Commission is in receipt of an application for costs from the Public Interest Advocacy Centre (PIAC)-Equitable Internet Coalition (EIC) in respect of its participation in the above-noted proceeding

Pursuant to section 66(3) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Rules of Procedure), a costs applicant must serve the application on all other parties.Footnote1

Commission staff notes that EIC, whose costs application was filed by PIAC, may not have served its application on the Canadian Network Operators Consortium Inc. (CNOC) as required.

By way of the present letter, therefore, CNOC is provided with notice of the claim for costs, which is posted on the Commission’s website under the “Costs” link associated with the above-noted file number. Specifically, given the size of EIC’s claim for costs, Commission staff also informs CNOC that it is being considered as a potential costs respondent in relation to said claim.

Pursuant to section 67 of the Rules of Procedure, potential costs respondents have ten days from the date the application is filed to file an Answer. In order to give CNOC a fair opportunity to respond, the period for filing an Answer is hereby modified as follows:

CNOC is requested to serve PIAC-EIC with its Answer. As per usual, PIAC-EIC may reply to any Answer within ten days.

A copy of this letter and all related correspondence will be added to the public record of the proceeding.
