Penalty: $30,000

Pursuant to sections 72.02 of the Telecommunications Act, S.C. 1993, c. 38(the Act), the undersigned has issued this Notice of Violation finding Groupe Hydro Hvac Inc.  to have committed the following violations contrary to the Canadian Radio-television and Telecommunications Commission’s (CRTC’s) Unsolicited Telecommunications Rules (the Rules) made under section 41 of the Act:

Between 20 November 2013 and 2 October 2014, telemarketing telecommunications were made by Groupe Hydro Hvac Inc., resulting in violations of the following Rules: of Part II, section 4 of the Rules for having made telemarketing calls to telephone numbers registered on the National Do Not Call List (DNCL); Part II, section 6 of the Rules for having made telemarketing calls without having purchased a subscription to the National DNCL; Part II, section 13 of the Rules for having used a verison of the National DNCL that was older than 31 days; Part III, section 2 of the Rules for having made telemarketing calls without registering with the National DNCL operator; and Part III, section 14 of the Rules for having made telemarketing telecommunications to telephone numbers that should have been on its Internal DNCL.  

Pursuant to section 72.01 of the Act, the undersigned has determined that the total penalty for the violations identified above is $30,000.

The penalty of $30,000 must be paid by Groupe Hydro Hvac Inc.  to “The Receiver General for Canada” in accordance with subsection 72.09(3) of the Act.
