Télébec, Limited Partnership - Basic residential bundle

Application

  1. The Commission received an application from Télébec, Limited Partnership (Télébec), dated 19 September 2014, in which the company proposed three modifications to item 2.17 - Basic residential bundleFootnote 1 of its General Tariff.

  2. Specifically, Télébec proposed to add

    • the word “Optimum” to the name of the service to match the name used to market the service;

    • certain rate bands that were available on the date of approval of the company’s Tariff Notice 404 (3 December 2009), but that, due to an administrative error, did not appear correctly in Tariff Notice 425 (approved on 6 April 2011), in which Télébec proposed tariff modifications related to the rate bands for this service; and

    • the Basic residential bundle - Optimum to four other rate bands, which did not appear in Tariff Notice 425 due to an administrative error.

  3. Due to the above-mentioned administrative errors, Télébec also requested that the Commission ratify the charging of the rates for the period from 6 April 2011 to 4 October 2014 for the first set of rate bands mentioned above, and for the periods starting on 1 September 2010, 1 October 2010, and 1 January 2013, and ending on 4 October 2014 for the four other bands.

  4. In accordance with Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin CRTC 2010-455, 5 July 2010, the Commission has approved Télébec’s application on an interim basis, effective 4 October 2014.

  5. The Commission did not receive any interventions regarding Télébec’s application. The public record of this proceeding, which closed on 14 October 2014, is available on the Commission’s website at www.crtc.gc.ca or by using the file number provided above.

Commission’s analysis and determinations

  1. With regard to Télébec’s ratification request, the Commission notes that, pursuant to subsection 25(4) of the Telecommunications Act, it may ratify the charging of a rate by a Canadian carrier otherwise than in accordance with a tariff approved by the Commission if it is satisfied that the rate was charged because of an error or other circumstance that warrants the ratification.

  2. The Commission is satisfied that Télébec did not indicate the rate band additions in question in its General Tariff due to administrative errors. In the circumstances, the Commission considers the company’s ratification request to be reasonable.

  3. Accordingly, the Commission approves on a final basis Télébec’s application. The Commission also ratifies the charging of the rates by Télébec for the period from 6 April 2011 to 4 October 2014 for the first set of rate bands mentioned in paragraph 2, as well as for the periods starting on 1 September 2010, 1 October 2010, and 1 January 2013, and ending on 4 October 2014 for the four other bands. Télébec is to issue revised tariff pagesFootnote 2 within 10 days of the date of this order.
