Pursuant to section 72.07 of the Telecommunications Act, S.C. 1993, c. 38 (the Act), the undersigned has issued this notice of violation finding the Marc Garneau Leadership Campaign to have committed the following violations contrary to the Canadian Radio-television and Telecommunications Commission’s (CRTC’s) Unsolicited Telecommunications Rules (the Rules) made under section 41 of the Act:

On 7 March 2013, unsolicited telecommunications were made by the Marc Garneau Campaign to conduct a poll. These telecommunications were made using an Automatic Dialing-Announcing Device (ADAD) resulting in violations of Part IV, subsection 4d) of the Rules, for not providing the name and address of the person on whose behalf the call was made in the messages.

Pursuant to section 72.01 of the Act, the undersigned has determined that the total penalty for the violations identified above is $2500.

The penalty of $2500 must be paid by the Marc Garneau Leadership Campaign to "The Receiver General for Canada" in accordance with subsection 72.09(3) of the Act.
