Re: Telecom Notice of Consultation CRTC 2013-80 – Review of outstanding wholesale high-speed access service issues related to optional upstream speed rates and modem certification requirements – Extension of process deadlines

In a letter dated 29 April 2013, the Commission staff issued interrogatories associated with Telecom Notice of Consultation CRTC 2013-80 and indicated that responses to the interrogatories were to be filed with the Commission and served on all interested parties by 8 May 2013. Further, parties were to file comments by 15 May 2013, and reply comments by 22 May 2013.

The Commission is in receipt of a letter, dated 8 May 2013, from Bell Aliant Regional Communications, Limited Partnership and Bell Canada (collectively, the Bell companies) stating that they are unable to provide all responses to interrogatories related to optional upstream speeds by the deadline indicated above.

On 15 May 2013, the Bell companies filed in confidence their responses to the following Commission interrogatories:

The Companies(CRTC)29Apr13-1 TNC 2013-80;
The Companies(CRTC)29Apr13-2 TNC 2013-80, parts a) and b); and
The Companies(CRTC)29Apr13-3 TNC 2013-80.

In addition, on 17 May 2013, the Bell companies filed in confidence their responses to the following Commission interrogatories:

The Bell companies submitted that their responses to the Commission interrogatories, dated 15 May 2013 and 17 May 2013, are confidential in their entirety.

In Telecom Regulatory Policy CRTC 2012-592, Confidentiality of information used to establish wholesale service rates, dated 26 October 2012, the Commission established demand disclosure guidelines which stated that competitor demand forecasts should generally be disclosed on the public record, provided that the forecast includes the demand of at least three competitors. Accordingly, to the extent the demand data filed on 15 May 2013 and 17 May 2013 is comprised of demand date representing at least three competitors, the Bell companies are to disclose this data, on the public record by 23 May 2013.

In addition, the Commission is in receipt of a letter, dated 21 May 2013, from Rogers Communication Partnership (Rogers) requesting that the 22 May 2013 deadline for filing reply comments be extended to 29 May 2013. Rogers submitted that it will not be able to complete their reply comments until 29 May 2013 due to the non-availability of engineering personnel.

By letter dated 21 May 2013, the Canadian Network Operators Consortium Inc. expressed their support for Rogers’ request for extension provided that the deadline is extended for all parties.

In light of the all of the above, Commission staff consider it appropriate that the remaining process dates, originally set out on 29 April 2013 be revised as follows:
All parties may file with the Commission and serve copies on all other parties, by 28 May 2013, comments solely in relation to the optional upstream speed rates for all incumbents’ wholesale high-speed access services; and
All parties may file with the Commission and serve copies on all other parties, by 4 June 2013 reply comments in relation to optional upstream speed rates and modem certification requirements.
To clarify, the timelines associated with the wholesale high-speed access service interface portion of Telecom Notice of Consultation CRTC 2013-80 remain unchanged.
