Re: Telecom Notice of Consultation CRTC 2011-77, Review of billing practices for wholesale residential high-speed access services (NoC 2011-77), as amended by NoC 2011-77-1 and NoC 2011-77-2 – Organization and conduct of the public hearing

Dear Madam/Sir:

As stated in the Commission’s letter dated 13 June 2011, this letter is intended to assist parties with respect to the structure and approach of their oral submissions.

Structure and approach of submissions

Parties are asked to present their submissions at the oral hearing in as plain language as possible, in accordance with the structure and approach set out in the Appendix to this letter.  Parties are requested to support their recommendations with appropriate rationale and to quantify the impact of these recommendations to the fullest extent possible.  The Commission Panel’s questions at the hearing will be structured consistent with the approach set out in the Appendix.

Parties are reminded that post-hearing submissions, which are to be filed with the Commission and copies served on other parties by 29 July 2011, must limit comments on the policy aspects of the proceeding to 15 pages.

Copies of documents filed

All parties are also reminded that, with respect to any documents filed at the oral hearing (such as prepared remarks, exhibits, or responses to undertakings), 30 copies must be provided to the Hearing Secretary for the Commission’s use.  Copies of all such documents must also be served on all other parties present at the oral hearing on the date the document is filed.

Appendix

 

Structure and approach of submissions

 

On the basis of the submissions received, please structure your oral submissions as follows:

1. Which of the billing models proposed by interveners should the Commission adopt?

2. If a usage component is adopted, which of the two different methods proposed for measuring usage should the Commission adopt?

(a) via peak traffic, or
(b) via volume

Provide the rationale for adopting either in terms of the impact on the independent ISPs’ monthly rates and their flexibility to compete in the market.  Identify and quantify any one-time or ongoing implementation issues.

3. Are there significant differences between the billing models in terms of impacts on incentives to build out networks and manage traffic?

4.Should there be symmetry with respect to the mark up on costs for all network providers?

5. Should the same mark up apply to monthly access rates and usage rates, whether billed jointly or separately?

6. Should the principles determined by the Commission in this proceeding, including principles regarding the billing models and the mark ups apply equally to legacy (existing) services, or should legacy services be treated differently?
