Dear Mr. Scofich and Mr. Henry:

Re: Bell Aliant Regional Communications, Limited Partnership - Application to direct TBayTel to provide dedicated services to Bell Aliant at CDN rates for its existing circuits, subject to certain phase-out periods

On 19 January 2011, Bell Aliant Regional Communications, Limited Partnership
(Bell Aliant), filed a Part VII application requesting that the Commission grant it treatment similar to that granted MTS Allstream Inc. and TELUS Communications Company in Decision 2010-897.  Specifically, Bell Aliant requested that the Commission direct TBayTel to provide dedicated services (the dedicated services) to Bell Aliant at CDN rates for its existing circuits, subject to the same phase-out periods provided in the Appendix to Decision 2010-897.

On 28 February 2011, the record relating to Bell Aliant’s Part VII application was closed.

With respect to Bell Aliant’s application, Commission staff requests further information from Bell Aliant and TBayTel, as provided in confidential Attachment 1.

For question 1), parties are to file their responses with the Commission in confidence, serving a copy on the other party, by 12pm EST on 28 April 2011.

For question 2), TBayTel is to file its response with the Commission exclusively and in confidence, by 12pm EST on 28 April 2011.

Documents to be filed and served in accordance with the above process are to be received, not merely sent, by the dates indicated.  Copies of the documents should also be sent to the following email address: kevin.pickell@crtc.gc.ca.
