TELUS Communications Company – Network Access Service

File numbers: Tariff Notices 396 and 396A

1.      The Commission received an application from TELUS Communications Company (TCC), dated 19 October 2010 and amended on 13 December 2010, in which the company requested approval of proposed revisions to its Carrier Access Tariff item 231, Wireless Service Providers (WSP) – Network Access Service. Specifically, TCC proposed to specify that any WSP interconnecting with TCC via a third-party transit provider must make arrangements for the third-party provider to bill all transit service charges directly to the WSP.

2.      The Commission approved TCC’s original application on an interim basis in Telecom Order CRTC 2010-804.

3.      The Commission received comments from Rogers Communications Inc. (RCI). The public record of this proceeding, which closed on 17 January 2011, is available on the Commission’s website at www.crtc.gc.ca under “Public Proceedings” or by using the file numbers provided above.

4.      RCI submitted that TCC’s proposed wording was not clear. It requested that TCC explicitly indicate that the charges listed in item 231.4.6, articles a to d, do not apply when a WSP uses common channel signalling 7 (CCS7) via a third-party transit provider. In its amended application, TCC revised its proposed wording to address RCI’s concern.

5.      The Commission notes that in Telecom Decision 2010-129, it directed TCC to permit the transiting of WSP CCS7 traffic via third-party arrangements.

6.      The Commission considers that TCC’s revisions have addressed RCI’s concern. The Commission also considers that the proposed tariff revisions in TCC’s amended application are consistent with the Commission’s directives in Telecom Decision 2010-129.

7.      In light of the above, the Commission approves on a final basis TCC’s applications.
