CKXT-TV Toronto – Licence amendment

1.      The Commission approves the applications by Quebecor Media Inc, on behalf of TVA Group Inc. (TVA Group), to amend the broadcasting licence for the television programming undertaking CKXT-TV Toronto to add transitional and post-transition digital transmitters to serve Toronto and Hamilton, Ontario.

2.      The Commission received an intervention in support of the present application, on the condition that TVA Group airs public service announcements (PSAs) to inform viewers of the transition to digital television (DTV). In this regard, the Commission notes that, in Broadcasting Regulatory Policy 2011-198, it announced that broadcasters would be required to broadcast PSAs relating to the DTV transition as of 1 May 2011. 3.      The post-transition digital transmitter serving Toronto will operate on channel 40 with an average effective radiated power (ERP) of 16,000 watts (maximum ERP of 16,000 watts with an effective height of antenna above average terrain (EHAAT) of 458 metres).

4.      The post-transition transmitter serving Hamilton will operate on channel 15 with an average ERP of 4,300 watts (maximum ERP of 9,100 watts with an EHAAT of 193.1 metres).

5.      The Commission notes that the licensee currently operates two transitional digital transmitters. The existing transitional digital transmitters will continue to operate under the same technical parameters as the previously licensed transitional DTV undertakings: CKXT-DT Toronto currently operates on channel 66 with an average ERP of 3,000 watts (maximum ERP of 3,000 watts with an EHAAT of 458 metres); CKXT-DT-1 Hamilton currently operates on channel 15 with an average ERP of 4,100 watts (maximum ERP of 8,800 watts with an EHAAT of 193.1 metres).

6.      The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, the licence amendment for the addition of the post-transition transmitters will only be effective when the Department of Industry (the Department) notifies the Commission that its technical requirements have been met and that broadcasting certificates will be issued. Therefore, in the absence of the notification by the Department, the applicant will not be able to implement the licence amendment approved in this decision.

7.      The post-transition transmitters must be operational at the earliest possible date and in any event no later than 31 August 2011. The Commission expects the licensee to inform it in writing once these transmitters are in operation.

8.      The Commission reminds the licensee that the authority to operate the transitional digital transmitters will expire on 31 August 2011.

9.      Given the approval of these applications, and at the licensee’s request, the Commission revokes the broadcasting licence for the transitional DTV undertaking CKXT-DT Toronto, which was granted pursuant to Broadcasting Decision 2004-65.
