Application by CHAU-TV Communications ltée to amend the broadcasting licence for the French-language conventional television programming undertaking CHAU-TV Carleton-sur-Mer in order to add post-transitional digital transmitters at Carleton-sur-Mer, Sainte-Marguerite-Marie, Port-Daniel, Chandler, Percé, Gaspé, Rivière-au-Renard, Cloridorme and Anse-au-Valleau, Quebec; and St-Quentin, Tracadie-Sheila and Kedgwick, New Brunswick.

The new transmitter at Carleton-sur-Mer would operate on channel 5 with an average effective radiated power (ERP) of 5,560 watts (maximum ERP of 9,850 watts with an effective height of antenna above average terrain (EHAAT) of 482.2 metres).

The implementation of this transmitter would increase the potential viewership by 1.3% from 170 000 to 172,157.

The new transmitter at Sainte-Marguerite-Marie would operate on channel 3 with an average ERP of 522 watts (maximum ERP of 1,680 watts with an EHAAT of 199.6 metres).

The implementation of this transmitter would increase the potential viewership by 173% from 25,270 to 69,083.

The new transmitter at St-Quentin would operate on channel 31 with an average ERP of 67 watts (maximum ERP of 226 watts with an EHAAT of 96.2 metres).

The implementation of this transmitter would increase the potential viewership by approximately 29% from 4,307 to 5,560.

The new transmitter at Port-Daniel would operate on channel 10 with an ERP of 7 watts (maximum ERP of 21 watts with an EHAAT of 152 metres).

The implementation of this transmitter would increase the potential viewership by 90% from 1,866 to 3,562.

The new transmitter at Chandler would operate on channel 26 with an average ERP of 75 watts (maximum ERP of 184 watts with an EHAAT of 22.3 metres).

The implementation of this transmitter would increase the potential viewership by 62% from 4,774 to 7,713.

The new transmitter at Percé would operate on channel 13 with an average ERP of 3,767 watts (maximum ERP of 10,375 watts with an EHAAT of 389.7 metres).

The implementation of this transmitter would increase the potential viewership by 23% from 35,604 to 43,636.

The new transmitter at Gaspé would operate on channel 7 with an ERP of 130 watts (non-directional antenna with an EHAAT of 75.6 metres).

The implementation of this transmitter would increase the potential viewership by 96% from 8,333 to 16,307.

The new transmitter at Rivière-au-Renard would operate on channel 4 with an average ERP of 300 watts (maximum ERP of 990 watts with an EHAAT of 228 metres).

The implementation of this transmitter would increase the potential viewership by 8% from 17,042 to 18,329.

The new transmitter at Cloridorme would operate on channel 11 with an average ERP of 37 watts (maximum ERP of 110 watts with an EHAAT of 30.4 metres).

The implementation of this transmitter would increase the potential viewership by 188% from 1,200 to 3,450.

The new transmitter at Anse-au-Valleau would operate on channel 12 with an average ERP of 43 watts (maximum ERP of 75 watts with an EHAAT of 54.1 metres).

The implementation of this transmitter would increase the potential viewership by approximately 242% from 1,280 to 4,377.

The new transmitter at Tracadie-Sheila would operate on channel 9 with an ERP of 25 watts (non-directional antenna with an EHAAT of 48.9 metres).

The implementation of this transmitter would increase the potential viewership by approximately 49% from 9,318 to 13,914.

The new transmitter at Kedgwick would operate on channel 27 with an ERP of 93 watts (non-directional antenna with an EHAAT of 66.6 metres).

The implementation of this transmitter would increase the potential viewership by approximately 166% from 1,890 to 5,026.

The Commission notes that this application is almost entirely in compliance with Notice No. SMBR-006-08 – Publication of the Digital Television (DTV) Post-Transition Allotment Plan of the Department of Industry (the Department), with the exception of two transmitters. In the case of the Chandler transmitter, the licensee proposes to use channel 26 instead of channel 6 as allotted by the Department and, in the case of the Cloridorme transmitter, the licensee proposes to use channel 11 instead of the allotted channel 16.

The Commission also notes that the licensee wishes to comply with Revised licensing framework for over-the-air digital television services, Broadcasting Regulatory Policy CRTC 2010-69, 10 February 2010.

The intervention must be received by the Commission and by the applicant on or before the above-mentioned date. The Commission cannot be held responsible for postal delays and will not notify a party whose intervention is received after the deadline date. The intervention will not be considered by the Commission and will not be part of the public file.

Interventions will be considered by the Commission and will form part of the public record of the proceeding without further notification to intervening parties, provided the procedure set out below has been followed. Parties will be contacted only if their submissions raise procedural questions.

A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.

The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.

Parties must ensure that, before initiating service through electronic mode, they will be able to satisfy the Commission, upon request, that service of the notification was completed.

Submissions longer than five pages should include a summary.

Each paragraph of the submission should be numbered. In addition, where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.

Interventions should clearly identify the application referred to and indicate whether parties support or oppose the application, or, if they propose changes to it, include the facts and grounds for their proposal.
