Licence renewals

1.      The Commission renews the broadcasting licences for the radio programming undertakings set out below from 1 June 2010 to 31 August 2016. The licences will be subject to the conditions of licence set out in the appropriate appendices to this decision.

2.      The Commission received interventions supporting CTV Limited's applications as well as a comment from the Association québécoise de l'industrie du disque, du spectacle et de la vidéo (ADISQ) with respect to the applications by Radio Beauce inc., 9183-9084 Québec inc., Radio Mégantic ltée, 9022-6242 Québec inc., Cogeco Diffusion inc., Réseau des Appalaches (FM) ltée and Groupe Radio Antenne 6 inc.

3.      In its comment, ADISQ deplored the fact that the Commission did not conduct any compliance evaluation of the musical programming of these stations throughout the licensees' last licence term. With regard to Canadian content development contributions, ADISQ noted that it could unfortunately not obtain all the information that would have enabled it to assess the stations' compliance with all of their requirements throughout the last licence term.

4.      The Commission did not receive any intervention in connection with the other applications. As part of this process, the Commission considered the interventions and replies received with respect to each of the applications. The public record for the proceeding is available on the Commission's website at www.crtc.gc.ca under “Public Proceedings.”

5.      The Commission reminds licensees that they must fulfil all of their remaining contributions to Canadian talent development set out in a prior Commission decision.

Appendix 2 to Broadcasting Decision CRTC 2010-322

Condition of licence for the commercial radio programming undertaking CJPR-FM Blairmore and its transmitters CJEV Elkford and CJPV-FM Pincher Creek

  1. The licence shall be subject to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009, with the exception of condition of licence 8 relating to the solicitation of local advertising.

Appendix 3 to Broadcasting Decision CRTC 2010-322

Conditions of licence for the commercial radio programming undertaking CKLJ-FM Olds

  1. The licence shall be subject to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009, with the exception of condition of licence 8 relating to the solicitation of local advertising.
  2. The licensee shall adhere to the Policy regarding open-line programming, Public Notice CRTC 1988-213, 23 December 1988.
  3. In addition to the required basic annual contribution to Canadian content development (CCD) set out in section 15 of the Radio Regulations, 1986, as amended from time to time, the licensee shall make a contribution of $3,500 in 2010 and, as of 2011, an annual contribution of $3,000 to the promotion and development of Canadian content.

    Of this amount, the licensee shall allocate no less than 20% per broadcast year to FACTOR. The remaining amounts of this additional CCD contribution shall be allocated to parties and initiatives fulfilling the definition of eligible initiatives set out in paragraph 108 of Commercial Radio Policy 2006, Broadcasting Public Notice CRTC 2006-158, 15 December 2006.

    Appendix 4 to Broadcasting Decision CRTC 2010-322

    Conditions of licence for the commercial radio programming undertaking CKLC-FM Kingston

    Condition of licence

    1. The licence shall be subject to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009.
    2. The licensee shall, as an exception to the percentage of Canadian musical selections set out in sections 2.2(8) and 2.2(9) of the Radio Regulations, 1986, in any broadcast week where at least 90% of musical selections from content category 2 (Popular Music) that it broadcasts are selections released before 1 January 1981:

      a)    devote, in that broadcast week, a minimum of 30% of its musical selections from content category 2 to Canadian selections broadcast in their entirety; and

      b)    devote, between 6 a.m. and 6 p.m., in the period from Monday to Friday of the same broadcast week, a minimum of 30% of its musical selections from content category 2 to Canadian selections broadcast in their entirety.

      The licensee will also be responsible for specifying, on the music lists it provides to the Commission, the year of release for all musical selections it broadcasts.

      For the purposes of this condition, the terms "broadcast week," "Canadian selection," "content category" and "musical selection" shall have the same meaning as that set out in the Radio Regulations, 1986.
    3. In addition to the basic annual contribution, commencing in the first year of operations, the licensee shall contribute $16,786 per year to the promotion and development of Canadian content. This amount shall vary in subsequent years of the licence term in accordance with the terms set out in the application as approved in Conversions to FM band and licensing of a new radio station to serve Kingston, Broadcasting Decision CRTC 2007-334, 28 August 2007 (Decision 2007-334).

      Commencing in the first year of operation, the licensee shall contribute $3,786 of this additional amount to FACTOR. This amount shall vary in subsequent years of the licence term in accordance with the terms set out in the application as approved in Decision 2007-334. The remainder of this additional amount in each year shall be allocated to parties and initiatives fulfilling the definition of eligible initiatives set out in paragraph 108 of Commercial Radio Policy 2006, Broadcasting Public Notice CRTC 2006-158, 15 December 2006.

      Appendix 5 to Broadcasting Decision CRTC 2010-322

      Conditions of licence for the low-power French-language religious FM radio programming undertaking VF8022 Crabtree

      1. The licensee shall broadcast programming consisting solely of religious services, with the exception of programs or program segments produced by it for the purpose of ensuring balance on matters of public concern. Such programs or program segments shall also comply with guidelines (i) to (iv) contained in section III.B.2a) of Religious Broadcasting Policy, Public Notice CRTC 1993-78, 3 June 1993.
      2. The licensee shall adhere to the guidelines on ethics for religious programming set out in section IV of Religious Broadcasting Policy, Public Notice CRTC 1993-78, 3 June 1993.
      3. The licensee shall not solicit or broadcast advertising.

      Appendix 6 to Broadcasting Decision CRTC 2010-322

      Conditions of licence for the French-language commercial radio programming undertaking CHRC Québec

      1. The licence shall be subject to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009.
      2. In each broadcast week, the licensee shall broadcast, at a minimum, 115 minutes of News (subcategory 11) programming.

        For the purpose of this condition, "broadcast week" shall have the same meaning as that set out in the Radio Regulations, 1986.

        Appendix 7 to Broadcasting Decision CRTC 2010-322

        Conditions of licence for the French-language commercial radio programming undertakings CFGE-FM Sherbrooke and its transmitter CFGE-FM-1 Magog and CJEB-FM Trois-Rivières

        1. The licence shall be subject to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009.
        2. The licensee shall devote a minimum of 45% of all category 2 (Popular Music) selections aired during the broadcast week to Canadian selections broadcast in their entirety.
        3. The licensee shall ensure that:
        • the radio station hires its own journalists for local programming purposes;
        • the radio station's journalists are assigned exclusively to preparing and presenting information programming aired by the radio station; and
        • the radio station's journalists report directly and exclusively to the station's director of radio programming.

        Appendix 8 to Broadcasting Decision CRTC 2010-322

        Conditions of licence for the Type B Native FM radio programming undertaking CKTI-FM Kettle Point

        1. The licensee shall devote a minimum of 35% of all category 2 (Popular Music) selections aired during the broadcast week to Canadian selections broadcast in their entirety.
        2. The licensee shall adhere to the Canadian Association of Broadcasters' Equitable Portrayal Code, as amended from time to time and approved by the Commission.
        3. The licensee shall adhere to the Canadian Association of Broadcasters' Broadcast Code for Advertising to Children, as amended from time to time and approved by the Commission.

        Appendix 9 to Broadcasting Decision CRTC 2010-322

        Conditions of licence for the English-language low-power tourist information FM radio programming undertaking CFCD-FM Dryden

        1. The licensee must use the station solely for the purpose of providing pre-recorded messages promoting tourist sites, attractions, activities of interest and events taking place in the Dryden area.
        2. The licensee shall not broadcast any advertising material.
        3. The licensee shall not broadcast musical selections, except as incidental background music.

        Appendix 10 to Broadcasting Decision CRTC 2010-322

        Conditions of licence for the English-language very low-power FM radio programming undertaking VF2413 North Battleford

        1. The licensee shall use the station solely for the purpose of broadcasting music related to exhibits or special events at the museum and information related to the museum.
        2. The licensee shall not broadcast any advertising material.

        Appendix 11 to Broadcasting Decision CRTC 2010-322

        Condition of licence for the English-language low-power FM radio programming undertaking VF2360 Carcross

        1. The licensee shall broadcast programming consisting exclusively of information on weather and road conditions.

        Appendix 12 to Broadcasting Decision CRTC 2010-322

        Conditions of licence for the ethnic commercial radio programming undertaking CHKF-FM Calgary

        1. The licence shall be subject to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009, with the exception of condition of licence 7.
        2. The licensee shall broadcast, during each broadcast week, programming directed to a minimum of 10 ethno-cultural groups in a minimum of 19 languages.
        3. The licensee shall allocate its basic annual Canadian content development contribution to music initiatives that reflect the ethnic character of the station.
        4. The licensee shall broadcast not less than 87 hours of local programming during each broadcast week.
        5. The licensee shall fulfill the remaining benefits resulting from the change of control authorized in Applications processed pursuant to streamlined procedure, Broadcasting Public Notice CRTC 2007-99, 5 September 2007, by allocating an annual amount of $3,034 until the end of the 2014 broadcast year.

        Appendix 13 to Broadcasting Decision CRTC 2010-322

        Conditions of licence for the English-language commercial radio programming undertaking CHMJ Vancouver

        1. The licence shall be subject to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009.
        2. The licensee shall allocate its basic annual Canadian content development contribution to initiatives that support and reflect the spoken word content of the station.

        Appendix 14 to Broadcasting Decision CRTC 2010-322

        Conditions of licence for the English-language commercial radio programming undertaking CKJH Melfort

        1. The licence shall be subject to the conditions set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009.
        2. The licensee shall, as an exception to the percentage of Canadian musical selections set out in sections 2.2(8) and 2.2(9) of the Radio Regulations, 1986, in any broadcast week where at least 90% of musical selections from content category 2 (Popular Music) that it broadcasts are selections released before 1 January 1981:

        The licensee will also be responsible for specifying, on the music lists it provides to the Commission, the year of release for all musical selections it broadcasts.

        For the purposes of this condition, the terms "broadcast week," "Canadian selection," "content category" and "musical selection" shall have the same meaning as that set out in the Radio Regulations, 1986

        Appendix 15 to Broadcasting Decision CRTC 2010-322

        Condition of licence for the English-language low-power FM radio programming undertaking VF2358 Stewart Crossing

        1. The licensee shall broadcast programming consisting exclusively of tourist information relating to the history of the Silver Trail.

        Appendix 16 to Broadcasting Decision CRTC 2010-322

        Conditions of licence for the English-language low-power FM radio programming undertaking VF2366 Sourdough

        1. The licensee shall broadcast programming consisting exclusively of tourist information relating to small communities along the South Klondike Highway.
        2. The licensee shall not broadcast any advertising material.

        [1] At the time of the issuance of Broadcasting Notice of Consultation 2009-787, Golden West Broadcasting Limited was the licensee of the station CHAB Moose Jaw. On 29 March 2010, in Broadcasting Decision 2010-188, the Commission authorized the acquisition by 101142236 Saskatchewan Ltd. of the assets of that station.

        [2] The applications 2008-1577-2, 2008-1578-0 and 2008-1579-8 were originally filed by Phil Wintemute in his capacity as Manager. Mr. Wintemute has informed the Commission that as of 31 May 2010, the position of Manager will be taken over by Lisa Badenhorst. The licences will be issued to the Manager, Telecom Services, Information and Communications Technology Department, Highways and Public Works, Government of Yukon, authorizing Lisa Badenhorst in her capacity as the said Manager, and any subsequent person occupying that position, to operate the aforementioned undertaking. The person occupying that position must be eligible to hold a broadcasting licence in accordance with Direction to the CRTC (Ineligibility of Non-Canadians), P.C. 1997-486, 8 April 1997, as amended by P.C. 1998-1268, 15 July 1998. The Commission must be advised in writing when the person occupying this position changes.
