Re:  Telecom Notice of Consultation CRTC 2009-261, Proceeding to consider the appropriateness of mandating certain wholesale high-speed access services

Dear Madams, Sirs:

Further to Commission staff’s letter of 10 November 2009 and to assist parties with respect to the scope of the proceeding regarding matters of co-location and transport facilities, Commission staff provides the following clarifications regarding CO-based ADSL access solutions that would be within the scope of the proceeding.

With respect to co-location, the scope of the proceeding would include arrangements involving co-location by the competitor itself, or through third party co-located competitors. Further, the scope of the proceeding would include interconnection arrangements just outside the ILEC’s CO that may not require co-location inside the CO.

With respect to transport facilities, the scope of the proceeding would include arrangements by which a competitor obtains transport facilities from other parties including the ILEC, as an alternative to the self-supply of such facilities.
