NorthernTel, Limited Partnership – Advanced Phone Service Bundle and Valu-ADD Bundle promotional campaigns

The Commission received applications by NorthernTel, Limited Partnership (NorthernTel), dated 24 August 2009, proposing to introduce two promotional campaigns regarding its General Tariff sub-items 10.02 – Advanced Phone Service Bundle and 15.1.09 – Valu-ADD Bundle.

NorthernTel proposed that under the terms of the promotional campaigns, customers subscribing to either the Advanced Phone Service Bundle or the Valu-ADD Bundle for 12 months and to a NorthernTel mobility service plan for 24 months would benefit from a 15 percent discount on the mobility service plan for a period of 12 months. NorthernTel indicated that the promotional campaigns would run from 8 September 2009 to 31 March 2010.

NorthernTel requested ratification of the rates it has charged between 10 August 2009 and the effective date of this order. NorthernTel submitted that due to a technical error on its part, it began offering the promotional campaigns to its customers before obtaining the Commission's prior approval.

The Commission notes that in Telecom Order CRTC 2009-554, 2 September 2009, it granted NorthernTel's applications interim approval effective 8 September 2009.

The Commission received no comments regarding these applications.

Pursuant to subsection 25(4) of the Telecommunications Act, the Commission may ratify the charging of a rate by a Canadian carrier otherwise than in accordance with a tariff approved by the Commission if the Commission is satisfied that the rate was charged because of an error or other circumstance that warrants the ratification.

The Commission finds that, under the circumstances, it is appropriate to ratify the charging of the rates by NorthernTel to customers who have subscribed to the promotional campaigns during the time the services were provided at rates otherwise than in accordance with a tariff approved by the Commission.

Accordingly, the Commission approves on a final basis NorthernTel's applications. In addition, the Commission ratifies the rates charged by NorthernTel for the two promotional campaigns for the period from 10 August 2009 to 8 September 2009.
