Rogers Broadcasting Limited (Rogers) has filed three applications to amend the broadcasting licences of television programming undertakings CKEM-TV Edmonton, CKAL-TV Calgary, and CHMI-TV Portage la Prairie/Winnipeg in order to increase their flexibility in fulfilling their described video programming commitments.

In Accessibility of telecommunications and broadcasting services, Broadcasting and Telecom Regulatory Policy CRTC 2009-430, 21 July 2009, the Commission invited conventional broadcasters to apply to amend their licences in order to provide these broadcasters with a measure of flexibility and to take into account requests from persons with disabilities for a wider choice of described programming. The Commission considered it appropriate to add two more categories of programming to those that licensees of conventional television stations may use to fulfil their commitments for described video: 9 Variety and 11 General entertainment and human interest.

Accordingly, Rogers requests the addition of programming categories 9 and 11 to the list of categories from which it can draw programming in order to meet its described video requirements.

The licensee proposes to replace the condition of licence set out in Licence renewals for four Craig television stations, Broadcasting Decision CRTC 2002-304, 11 October 2002, relating to described video, which reads:

  1. Beginning 1 September 2003, the licensee shall broadcast an average of 2 hours per week of described Canadian priority programs.

  2. Beginning 1 September 2005, and for the remainder of the licence term, the licensee shall broadcast an average of 4 hours per week of described Canadian priority programs.

In fulfilling this condition, a minimum of 50% of the required hours must be original broadcasts. Further, the licensee may broadcast up to one hour per week of described children’s programming at an appropriate children’s viewing time.

with the following condition (change in bold):

  1. Beginning 1 September 2003, the licensee shall broadcast an average of 2 hours per week of described Canadian priority programs

  2. Beginning 1 September 2005, and for the remainder of the licence term, the licensee shall broadcast an average of 4 hours per week of described Canadian priority programs.

As of 21 July 2009, the licensee may fulfill its commitments for described video with programming from the following categories set out in Item 6 of Schedule I to the Television Broadcasting Regulations, 1987: 2(b) Long-form documentary; 7(a) Ongoing Dramatic Series; 7(b) Ongoing comedy series (sitcoms); 7(c) Specials, mini-series or made-for-TV feature films; 7(d) Theatrical feature films aired on TV; 7(e) Animated television programs and films; 7(g) Other drama; 9 Variety; and 11 General entertainment and human interest, as well as programming targeted to children.

In fulfilling this condition, a minimum of 50% of the required hours must be original broadcasts. Further, the licensee may broadcast up to one hour per week of described children’s programming at an appropriate children’s viewing time.

The intervention must be received by the Commission and by the applicant on or before the above-mentioned date. The Commission cannot be held responsible for postal delays and will not notify a party whose intervention is received after the deadline date. The intervention will not be considered by the Commission and will not be part of the public file.

Interventions will be considered by the Commission and will form part of the public record of the proceeding without further notification to intervening parties, provided the procedure set out below has been followed. Parties will be contacted only if their submissions raise procedural questions.

A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.

The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.

Parties must ensure that, before initiating service through electronic mode, they will be able to satisfy the Commission, upon request, that service of the notification was completed.

Submissions longer than five pages should include a summary.

Each paragraph of the submission should be numbered. In addition, where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.

Interventions should clearly identify the application referred to and indicate whether parties support or oppose the application, or, if they propose changes to it, include the facts and grounds for their proposal.
