Applications 2009-1167-9, 2009-1168-7, 2009-1169-5, 2009-1170-3 and 2009-1171-0, received 19 August 2009

Class 1 terrestrial broadcasting distribution undertakings – Licence amendments

1. The Commission approves the applications by Shaw Communications Inc. (Shaw), on behalf of Shaw Cablesystems Limited, to amend the broadcasting licences for the terrestrial broadcasting distribution undertakings serving Kamloops, Kelowna, Penticton, Prince George and Vernon, British Columbia, by replacing the condition of licence relating to the distribution of the signals of the four U.S. commercial networks (CBS, NBC, ABC, FOX) and the non-commercial network PBS (collectively, the U.S. 4+1 signals). The Commission did not receive any interventions in connection with these applications.

2. These applications follow the Commission’s requirement, set out in Various cable broadcasting distribution undertakings across Canada – Licence amendments, Broadcasting Decision CRTC 2009-488, 13 August 2009 (Broadcasting Decision 2009-488), that Shaw file with the Commission an application for an amendment to the broadcasting licences for the systems serving the above-noted locations so as to distribute on those systems, as part of the basic service, the FOX signal KCPQ-TV Seattle, Washington, instead of the FOX signal KAYU-TV Spokane, Washington. In Broadcasting Decision 2009-488, the Commission noted that, while FOX distributes the signal KAYU-TV as part of the basic service, it does not distribute the high definition (HD) signal of KAYU-TV, but the HD signal of KCPQ-TV.

3. Accordingly, for the five cable systems noted above, the condition of licence relating to the distribution of U.S. 4+1 signals shall read as follows:

The licensee is authorized to distribute, at its option, KIRO-TV (CBS), KING-TV (NBC), KOMO-TV (ABC), KCPQ-TV (FOX) and KCTS-TV (PBS) Seattle, Washington, as part of the basic service.
