Call for comments on new draft regulations concerning CRTC Rules of Practice and Procedure

 

Clarification of scope

In Broadcasting and Telecom Notice of Consultation 2009-602, the Commission called for comments on new draft regulations entitled Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Proposed Rules). Sections 53 to 66 of the Proposed Rules set out the rules applicable to requests for the award and payment of costs pursuant to section 56 of the Telecommunications Act (the Act). These rules would replace the provisions for costs set out in section 44 of the existing CRTC Telecommunications Rules of Procedure (the Existing Rules).

In Telecom Notice of Consultation 2009-716, issued today, the Commission has initiated a proceeding to review its telecommunications costs award practices and procedures (the Telecom Costs Proceeding). The Commission notes that the Telecom Costs Proceeding seeks comments on substantive changes that should be made, if any, to its current costs award practices and procedures. These practices and procedures are found not only in the Existing Rules, but also in the Legal Directorate's Guidelines for the Taxation of Costs and in precedents established by previous Commission costs awards.

In light of the scope of the Telecom Costs Proceeding, comments made in the current proceeding related to sections 53 to 66 of the Proposed Rules are to focus on whether the proposed language accurately reflects current Commission costs award practices and procedures. Comments regarding changes to the Commission's current costs award practices and procedures should be filed in the context of the Telecom Costs Proceeding.

As stated in Telecom Notice of Consultation 2009-716, any changes to the Commission's current costs award practices and procedures will be announced in a regulatory policy. Any substantive amendments to the wording of the Proposed Rules necessary to implement these changes will be published for public comment pursuant to section 69 of the Act.

The deadline to provide comments in the proceeding on the Proposed Rules remains 17 December 2009.
