The licensee proposes to replace the conditions of licence relating to the adherence to industry codes regarding violence and programming standards and practices which currently read as follows: |

The licensee shall adhere to the Pay television and pay-per-view programming code regarding violence, as amended from time to time and approved by the Commission. The application of the foregoing condition of licence will be suspended as long as the licensee remains a member in good standing of the Canadian Broadcast Standards Council.

Proposed condition of licence relating to the adherence to the industry code regarding programming standards and practices:

The licensee shall adhere to the Industry code of programming standards and practices governing pay, pay-per-view and video-on-demand services, as amended from time to time and approved by the Commission. The application of the foregoing condition of licence will be suspended as long as the licensee remains a member in good standing of the Canadian Broadcast Standards Council.

Movie Central states that they filed this application pursuant to recent discussions with the Canadian Broadcast Standards Council (CBSC) concerning the CBSC's willingness to assume responsibility for the administration of both the Pay television and pay-per-view programming code regarding violence and the Industry code of programming standards and practices governing pay, pay-per-view and video-on-demand services. |

The CBSC has also forwarded a letter to the Commission with the purpose to advise the Commission that they are prepared to assume responsibility for the administration of both of these Codes. |

Movie Central adds that the approval of this application would allow the CBSC to address and resolve any complaints it might receive concerning violence in its programming content, or with respect to its programming standards and practices. |

Application by Rogers Broadcasting Limited (RBL) relating to the licence of the commercial English-language radio programming undertaking CKMH-FM Medicine Hat. |

RBL proposes to change the transmission facilities for CKMH-FM from its original licensed location, which is owned by the Canadian Broadcasting Corporation, to a tower owned by CKUA Radio Foundation (CKUA). |
| |
RBL indicates that the tower owned by CKUA is a better choice as the contour is wider with a consistent signal, the costs are lower and the antenna will be easier to construct and implement. |
| |
The Commission notes that the new proposed technical parameters would increase the originally proposed contours. |
