Encore Avenue - Licence amendments

1. The Commission approves the application by Encore Avenue Ltd. to amend the broadcasting licence for the English-language pay television programming undertaking known as Encore Avenue. Specifically, the Commission amends the conditions of licence relating to the Pay television and pay-per-view programming code regarding violence and the Pay television programming standards and practices code, in order to reflect the replacement of the second code by the Industry code of programming standards and practices governing pay, pay-per-view and video-on-demand services 1 and to allow the Canadian Broadcast Standards Council (CBSC) to address and resolve any complaints it might receive concerning issues covered by both codes.
2. The Commission notes that it received a letter from the CBSC advising that it is prepared to assume responsibility for the administration of the two codes.
3. The Commission did not receive any interventions in connection with this application.
4. Accordingly, the new conditions of licence shall read as follows:

The licensee shall adhere to the Pay television and pay-per-view programming code regarding violence, as amended from time to time and approved by the Commission. The application of the foregoing condition of licence will be suspended as long as the licensee remains a member in good standing of the Canadian Broadcast Standards Council.

The licensee shall adhere to the Industry code of programming standards and practices governing pay, pay-per-view and video-on-demand services, as amended from time to time and approved by the Commission. The application of the foregoing condition of licence will be suspended as long as the licensee remains a member in good standing of the Canadian Broadcast Standards Council.
