CHNC New Carlisle and its transmitter CHGM Gaspé

  The Commission renews the broadcasting licence for French-language commercial radio station CHNC New Carlisle and its transmitter CHGM Gaspé from 1 September 2008 to 31 August 2010. The licence will be subject to the conditions set out in Public Notice 1999-137.
 

Introduction

The Commission received an application originally submitted by Radio CHNC ltée to renew the broadcasting licence for the French-language commercial radio programming undertaking CHNC New Carlisle and its transmitter CHGM Gaspé. The current licence expires 31 August 2008.

The Commission received one comment from the Association québécoise du disque, du spectacle et de la vidéo (ADISQ). The public record for this proceeding is available on the Commission's website at www.crtc.gc.ca under "Public Proceedings."
 

Commission's analysis and determinations

In Broadcasting Decision 2008-51, the Commission approved an application by Radio CHNC ltée to convert the AM radio station CHNC New Carlisle to the FM band and add FM transmitters in Gaspé, Carleton, Chandler and Percé. The new licence granted in that decision expires 31 August 2014. In this same decision, the Commission addressed, among other issues, the non-compliance of Radio CHNC ltée.

On 27 June 2008, the Commission approved the application by Coopérative des travailleurs CHNC to acquire the assets of both CHNC and its transmitter CHGM - the other transmitters were not yet in operation.

The Commission notes the intervention by ADISQ. However, given that the station and its transmitter are presently operated by Coopérative des travailleurs CHNC and that the Commission addressed the issue of the previous licensee's non-compliance in Broadcasting Decision 2008-51, the Commission considers that there is no reason to re-examine this issue.

Moreover, given that the FM undertaking and its new transmitters must be operational by 3 March 2010, the Commission considers it reasonable to renew the licence for the AM station CHNC and its transmitter CHGM until the end of the broadcast year in which the new FM undertaking and its transmitters must be operational.

In light of the above, the Commission renews the broadcasting licence for the French-language commercial AM radio programming undertaking CHNC New Carlisle and its transmitter CHGM Gaspé from 1 September 2008 to 31 August 2010. The licence will be subject to the conditions set out in Public Notice 1999-137 with the exception of conditions nos. 1 and 5. The licence will also be subject to the following condition of licence:
 
  • The licensee shall adhere to the Canadian Association of Broadcasters' Equitable Portrayal Code, as amended from time to time and approved by the Commission. However, the application o the foregoing condition of licence will be suspended if the licensee is a member in good standing of the Canadian Broadcast Standards Council.
