  with the following condition:

The licensee is authorized to make available for distribution, until 8 October 2010, a version of its service in high definition format, provided that not less than 95% of the video and audio components of the upgraded and analog versions of the service are the same, exclusive of commercial messages and of any part of the service carried on a subsidiary signal. All of the programming making up the 5% allowance shall be provided in high definition.

The licensee advises that its condition of licence regarding the distribution in high definition (HD) format is due to expire on 8 October 2007. 3. Abbotsford, British Columbia
Application No. 2007-0808-4
Application by the Canadian Broadcasting Corporation (CBC) to amend the licence of the radio programming undertaking CBU Vancouver, British Columbia.
The licensee proposes to add an FM transmitter at Abbotsford to broadcast its programming service Radio One originating from CBU Vancouver in order to adequately serve the population of Abbotsford.
The transmitter would operate on frequency 101.7 MHz (channel 269A) with an average effective radiated power of 67 watts (maximum effective radiated power 316 watts/effective antenna height of 150.4 metres).
The CBC indicates that the signal of its station CBU Vancouver is deficient in Abbotsford and the proposed FM transmitter would provide a more reliable service in Abbotsford and the surrounding areas.
The CBC also indicates that this transmitter was previously approved by the Commission in Broadcasting Decision CRTC 2004-404, 7 September 2004 (Decision CRTC 2004-404).
In its decision, the Commission stated the following:

The transmitter must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 7 September 2006.

The CBC did not get the transmitter operational by the 7 September 2006 and omitted to request an extension of time to implement it.
Consequently, the authority contained in Decision CRTC 2004-404 became null and void as of 7 September 2006.
The CBC confirms its intention to proceed with this undertaking and has therefore filed this application.
