Revocation of licences - Exempted cable broadcasting distribution undertakings that serve between 2,000 and 6,000 subscribers

Cogeco Cable Canada Inc. (Cogeco) has confirmed its eligibility for exemption in accordance with Exemption of cable broadcasting distribution undertakings that serve between 2,000 and 6,000 subscribers, Broadcasting Public Notice CRTC 2003-23, 30 April 2003 (Public Notice 2003-23), and with Exemption order respecting cable broadcasting distribution undertakings that serve between 2,000 and 6,000 subscribers; and Amendment to the Broadcasting Distribution Regulations, Broadcasting Public Notice CRTC 2004-39, 14 June 2004 (Public Notice 2004-39).

Cogeco indicates that the Chalk River and Deep River systems are fully interconnected to its Pembroke system and that the total number of subscribers served by these three interconnected systems is less than 6,000 subscribers. Therefore, it has requested the revocation of its licences for the cable distribution undertakings serving Pembroke, Chalk River and Deep River, Ontario.

In paragraph 45 of Public Notice 2003-23, the Commission stated the following:
 

It is the Commission's determination that, where separately licensed undertakings are fully interconnected, they will be eligible for exemption only if the total number of subscribers served by the interconnected systems does not exceed 6,000. In order to accommodate subscriber growth, exempt undertakings would, in the future, be able to exceed the 6,000 subscriber threshold by up to 10%, i.e., by up to 600 more subscribers, without licensing. The Commission notes that this approach is consistent with that taken in the Small cable exemption order.

Given the licensee's request, the Commission revokes, pursuant to sections 9(1)(e) and 24(1) of the Broadcasting Act, the broadcasting licences issued to Cogeco Cable Canada Inc. for the undertakings serving Pembroke, Chalk River and Deep River, Ontario.

The Commission reminds the operator of these undertakings that it must comply, at all times, with the criteria contained in the exemption order attached to Public Notice 2004-39 as well as with its determination regarding the total number of subscribers for these three fully interconnected undertakings as stated in Public Notice 2003-23.
