CHUC-FM Cobourg - Extension of simulcast period

The Commission approves the application by Pineridge Broadcasting Inc. (Pineridge) to amend the broadcasting licence for the radio programming undertaking CHUC-FM Cobourg, in order to extend the period of time during which the licensee is permitted to simulcast the programming of CHUC-FM on the AM station CHUC Cobourg.

In CHUC Cobourg - Conversion to FM band, Broadcasting Decision CRTC 2005-205, 19 May 2005 (Decision 2005-205), the Commission approved an application by Pineridge for a broadcasting licence to operate a new English-language FM radio programming undertaking to replace CHUC. In that decision, the Commission also authorized, by condition of licence, a transition period of three months, following commencement of operation of the new FM station, during which Pineridge would be permitted to simulcast the programming of CHUC-FM on the AM band. In addition, following a request by the licensee, the Commission indicated in Decision 2005-205 that the licence for CHUC would be revoked at the end of this three-month simulcast period. Pineridge confirmed that it commenced the operation of CHUC-FM on 11 August 2006.

In its application, Pineridge stated that CHUC-FM has generated intermodulation products that fall within the NAV/COM band and that, despite the fact that the licensee has taken several measures to correct the problem, the situation still exists. In this regard, Pineridge has submitted a separate application for a technical amendment proposing a change to the authorized contours of the station that would serve to correct the reception difficulties. That application was gazetted in Broadcasting Public Notice CRTC 2007-6, 16 January 2007. According to Pineridge, the requested extended simulcast period would permit it to resolve the situation.

The Commission received an intervention in support of this application.

The licensee is authorized, by condition of licence, to simulcast the programming of CHUC-FM Cobourg on the AM station CHUC from 11 November 2006 to 11 November 2007. Pursuant to sections 9(1)(e) and 24(1) of the Broadcasting Act, the Commission revokes the licence for CHUC Cobourg effective at the end of this simulcast period.
