CIXX-FM London - Licence renewal and licence amendment

  In this decision, the Commission renews the broadcasting licence for the instructional campus radio programming undertaking CIXX-FM London, and approves an application to amend that broadcasting licence in order to replace the condition of licence relating to the broadcast of formal educational programming.
 

Introduction

The Commission received an application by Radio Fanshawe Incorporated (Fanshawe) to renew the broadcasting licence for the instructional campus radio programming undertaking CIXX-FM London. The current licence expires on 31 August 2007.

As part of its licence renewal application, Fanshawe requested that the Commission amend the licensee's broadcasting licence by replacing condition of licence number 13 of Public Notice 2000-156 relating to the broadcast of formal educational programming, which reads as follows:

It is a condition of licence that the licensee devote, during each broadcast week, at least two hours of its programming to formal educational programming that provides academic instruction.

with the following condition of licence:

It is a condition of licence that the licensee devote, during each broadcast week, at least two hours of its programming to spoken word programming as researched and produced by students for curriculum requirements.

The licensee supported its request by stating that it is finding it very difficult, if not impossible, to find two hours of formal educational programming, given the continuing increase in the availability of online courses and more widespread Internet access.

Finally, the licensee agreed to accept a condition of licence requiring it to devote, in each broadcast week, a minimum of 12% of its musical selections from content category 3 (Special interest music) to Canadian selections broadcast in their entirety.

The Commission did not receive any interventions in connection with this application.
 

Commission's analysis and determinations

In Public Notice 2000-12 (the Campus Radio Policy), the Commission considered that the primary role of an instructional campus radio station is to provide a training ground for students in broadcasting courses. The Commission also stated that these stations must also provide their audiences with alternative programming, which should include music - in particular Canadian music - that is generally not heard on commercial radio stations (this includes special interest music as well as popular music that is seldom broadcast). In the Campus Radio Policy, the Commission also indicated that instructional campus radio stations must provide their audience with in-depth spoken word programming, as well as some formal educational programming.

The Commission notes that the licensee proposed to replace its two hours of formal educational programming with additional spoken word programming, and that these additional hours of spoken word programming would consist of student-produced content relevant to the residents of London. The licensee also proposed that this additional spoken word programming would be alternative in nature and would complement the programming, not only of commercial radio stations, but also of other campus radio stations operating in the same area. The Commission also notes Fanshawe's commitment that CIXX-FM would support and air formal educational programming as this type of programming becomes more available and accessible.
 

Conclusion

In light of the above, the Commission renews the broadcasting licence for the instructional campus radio programming undertaking CIXX-FM London, from 1 September 2007 to 31 August 2014. The Commission also approves the licensee's request to replace the condition of licence relating to the broadcast of formal educational programming on CIXX-FM. The licence will be subject to the conditions set out in Public Notice 2000-156, with the exception of condition of licence number 13, as well as to the following conditions:
 
  • The licensee shall devote, in each broadcast week, a minimum of 12% of its musical selections from content category 3 (Special interest music) to Canadian selections broadcast in their entirety.
 
  • The licensee shall devote, in each broadcast week, two (2) hours of its programming schedule to spoken word programming as researched and produced by students for curriculum requirements.

The Commission expects the licensee to retain full control over all decisions concerning the management and programming of this station and to ensure that representatives of the student body, faculty, alumni or administration of the university or college with which the station is associated, considered together, form the majority of the board of directors. To ensure continuity of direction, the Commission encourages the licensee to establish positions on its board of directors with terms of more than one year. In addition, the Commission reminds the licensee that, in accordance with the requirements of Direction to the CRTC (Ineligibility of non-Canadians), P.C. 1997-486, 8 April 1997, as amended by P.C. 1998-1268, 15 July 1998, the Chair and not less than 80% of the members of the board of directors must be Canadians ordinarily resident in Canada.

The Commission considers that campus radio stations should be particularly sensitive to employment equity issues in order to reflect fully the communities they serve. It encourages the licensee to consider these issues in its hiring practices and in all other aspects of its management of human resources.
