Call for comments - Proposed amendments to the Television Broadcasting Regulations, 1987,the Pay Television Regulations, 1990 and the Specialty Services Regulations, 1990 - Requirements for the furnishing of program logs and records

1. The Commission considers that it would be appropriate to amend the Television Broadcasting Regulations, 1987, the Pay Television Regulations, 1990 and the Specialty Services Regulations, 1990 (collectively, the Regulations) in order to allow licensees to apply for a condition of licence regarding the requirement to furnish the Commission with a program log or machine-readable record of their programming. Proposed amendments to the Regulations that would make provision for such a condition of licence are appended to this public notice. The proposed amendments are intended to provide greater flexibility in the furnishing of program logs or records and to decrease the administrative burden on the Commission and licensees in certain circumstances.
 

Call for comments

2. The Commission invites comments on the proposed amendments appended to this notice. The Commission will accept comments that it receives on or before 24 April 2006.
3. The Commission will not formally acknowledge comments. It will, however, fully consider all comments and they will form part of the public record of the proceeding, provided that the procedures for filing set out below have been followed.

REGULATIONS AMENDING THE TELEVISION BROADCASTING REGULATIONS, 1987

  1. Subsection 10(3) of the Television Broadcasting Regulations, 19871  is replaced by the following:
  (3) Except as otherwise provided under a condition of its licence, a licensee shall furnish to the Commission, within 30 days after the end of each month, the program log or machine-readable record of the licensee for that month, together with a certificate signed by or on behalf of the licensee attesting to the accuracy of the contents of the log or record.

  2. These Regulations come into force on the day on which they are registered.
 

REGULATIONS AMENDING THE PAY TELEVISION REGULATIONS, 1990

 

amendment

  1. Subsection 4(2) of the Pay Television Regulations, 19901 is replaced by the following:
  (2) Except as otherwise provided under a condition of its licence, a licensee shall furnish to the Commission, within 30 days after the end of each month, a program log or machine-readable record of its programming for the month, with a certificate by or on behalf of the licensee attesting to the accuracy of the contents of the log or record.
 

coming into force

  2. These Regulations come into force on the day on which they are registered.
 

REGULATIONS AMENDING THE SPECIALTY SERVICES REGULATIONS, 1990

  1. Subsection 7(2) of the Specialty Services Regulations, 19901 is replaced by the following:
  (2) Except as otherwise provided under a condition of its licence, a licensee shall furnish to the Commission, within 30 days after the end of each month, a program log or machine-readable record of its programming for the month, with a certificate by or on behalf of the licensee attesting to the accuracy of the contents of the log or record.
 

coming into force

  2. These Regulations come into force on the day on which they are registered.
