  Application by CHUM Limited (CHUM) to renew the licence of the English-language commercial FM radio programming undertaking CHBE-FM Victoria, expiring 31 August 2006.
  CHUM proposes to delete the condition of licence which requires it to contribute $22,000 per year to Canadian Talent Development (CTD), including $14,000 per year for a New Music Festival and $3,000 per year for a Songwriter's Seminar.
  In its place, CHUM proposes to add a condition of licence which requires that it contribute $5,000 annually in CTD contributions to FACTOR over the period of seven years. This contribution is in accordance with the minimum required by the CTD plan created by the Canadian Association of Broadcasters.

  Application by TELUS Communications Inc. (TELUS) to amend the licence of the national video on demand (VOD) programming undertaking known as TELUS video on demand.
  The licensee proposes to add a condition of licence that would prohibit it from distributing programming that contains any commercial message except if the message is already included in a program previously aired by a Canadian television programming undertaking and is subsequently offered on an on-demand basis at no charge to the subscriber.
  To this end, TELUS proposes that the condition of licence pertaining to adherence to the Pay Television Regulations, 1990 be amended as follows:
 

The licensee shall adhere to the Pay Television Regulations, 1990, with the exception of section 3(2)(d) (commercial messages) and section 4 (logs and records).

  The applicant also proposes to add the following condition of licence :
 

TELUS shall not include as part of its VOD offering any program including a commercial message except where:

 

a. the message was already included in a program previously broadcast by a Canadian programming service;

 

b. the program's inclusion as part of the VOD offering is in accordance with the terms of a written agreement entered into with the operator of the Canadian programming service that broadcast the program; and

 

c. the program is offered to subscribers on an on-demand basis at no charge.

  TELUS Communications Inc. states it wishes to obtain more flexibility in offering television content on its VOD service.

  The licensee proposes to add a condition of licence that would prohibit it from distributing programming that contains any commercial message except if the message is already included in a program previously aired by a Canadian television programming undertaking and is subsequently offered on an on-demand basis at no charge to the subscriber.
  To this end, SaskTel proposes that the condition of licence pertaining to adherence to the Pay Television Regulations, 1990 be amended as follows:
 

The licensee shall adhere to the Pay Television Regulations, 1990, with the exception of section 3(2)(d) (commercial messages) and section 4 (logs and records).

  The applicant also proposes to add the following condition of licence:
