Applications granted approval pursuant to streamlined procedures

  In this public notice, the Commission publishes a list of applications involving transfers of ownership and changes in the effective control of broadcasting undertakings as well as applications for amendments or extensions of deadlines not requiring a public process that it has approved during the period 1 July 2006 to 31 August 2006 pursuant to its streamlined procedure.

The Commission has a streamlined procedure for its consideration of applications involving transfers of ownership and changes in the effective control of broadcasting undertakings as well as applications for amendments or extensions of deadlines not requiring a public process. Under this procedure, and on a case-by-case basis, the Commission may approve such an application without first having issued a public notice provided that:
 

a) its examination of the application reveals the presence of no significant policy concern; and

 

b) the Commission is convinced that approval would be consistent with its approvals of previous applications.

Where these two conditions are met, the Commission is generally satisfied that a process initiated by a public notice is not required in the public interest, and would unnecessarily delay implementation of the transaction contemplated or of other proposals by the applicant.

In the appendices to this public notice, the Commission publishes a list of applications involving transfers of ownership and changes in the effective control of broadcasting undertakings (Appendix 1) as well as applications for amendments or extensions of deadlines not requiring a public process (Appendix 2) that it has approved during the period 1 July 2006 to 31 August 2006 pursuant to its streamlined procedure.

ONE : The Body, Mind and Spirit Channel Inc. 2006-0858-1

Change in the ownership of ONE: The Body, Mind and Spirit Channel Inc. (ONE), resulting in an increase in Alliant Atlantis Broadcasting Inc.'s voting interest in ONE, from 29.90% to 37.77%.

ONE's ultimate control is not affected and continues to be exercised by Vision TV, in accordance with the Voting Trust Agreement of 2001 between the shareholders.

ONE is the licensee of the national, Category 1 specialty programming undertaking carrying on business under the same name.

Corporate reorganization changing the effective control of Stuart Media Group Inc., licensee of the national, Category 2 specialty programming undertaking known as CGTV Canada, from Penetanguishene-Huronia Bingo, Inc. to its parent corporation, Plaza Gaming and Entertainment Corp.

Corporate reorganization changing the effective control of The Family Channel Inc. (Family Channel), through the transfer of all Family Channel's shares, from Astral Broadcasting Group Inc. (Astral) to a new subsidiary of Astral.

Note: Following this transaction, the new subsidiary and Family Channel intend to amalgamate and continue under the name of The Family Channel Inc.

Family Channel is the licensee of the national, pay television programming undertaking, carrying on business under the same name. In 2006, Family Channel was also authorized to operate two national, Category 2 specialty programming undertakings, which have not yet commenced operations.

Teletoon Canada Inc. 2006-0798-9

Change in the ownership of Teletoon Canada Inc. (Teletoon Inc.), through an equal transfer to YTV Canada, Inc. and to The Family Channel Inc., of the 20% voting interest of Teletoon Inc. held by Cookie Jar Group of Companies.

This transaction does not affect the effective control of Teletoon Inc., which is exercised by its board of directors.

Teletoon Inc. is the licensee of the national, specialty programming undertaking known as Teletoon/Télétoon. In 2005, Teletoon Inc. was also authorized to operate two national, Category 2 specialty programming undertakings, which have not yet commenced operations.

Radio CJVR Ltd. 2006-0790-6

Change in the ownership of Fabmar Investments Ltd. (Fabmar), affecting the control of Radio CJVR Ltd. (Radio CJVR), as a result of the wind-up in favour of the beneficiaries of the Fabro Family Trust, holder of all of Fabmar's voting shares. Fabmar is the parent corporation of Radio CJVR. As a result of this transaction, the effective control of Fabmar and of Radio CJVR, has changed from a control exercised by the trustees to a control exercised by the Board of Directors.

Radio CJVR is the licensee of CKJH Melfort, Saskatchewan, CJVR-FM Melfort and its transmitters CJVR-FM-1 Dafoe, CJVR-FM-2 Waskesiu Lake and a new transmitter in Carrot River, which was approved recently.
