Unserved Premise Improvement

1.

The Commission received an application by Saskatchewan Telecommunications (SaskTel), dated 16 June 2006, proposing revisions to its General Tariff - Basic Services item 105.16, SaskTel Unserved Premises Improvement Tariff, to extend the availability of this tariff from 1 June 2006 to 31 May 2008.

The Commission did not receive any comments with respect to this application.

The Commission notes that, currently, SaskTel Unserved Premise Improvement Tariff provides residential customers applying for a first residential access line to an unserved residential premise within the Agricultural Area of the province between 31 May 2004 and 31 May 2006, the option to choose the lesser of the applicable construction charges:
 

a) calculated pursuant to SaskTel General Tariff - Basic Services, item 105.15, Extra Provisioning Charges; or

 

b) calculated pursuant to tariff item 105.16.

The Commission notes that SaskTel's customers would benefit from the extension of item 105.16 from 1 June 2006 to 31 May 2008, as proposed by the company. The Commission notes that it may not lawfully approve rates on a retroactive basis. The Commission may however, pursuant to subsection 25(4) of the Telecommunications Act (the Act), ratify the charging of a rate by a Canadian carrier otherwise than in accordance with a tariff approved by the Commission if the Commission is satisfied that the rate warrants the ratification. Accordingly, to the extent that SaskTel has been providing the service from 1 June 2006 to the date of this Order, the Commission considers it appropriate to ratify the charging of the rates as set out in the expired tariff.

Accordingly, the Commission approves on an interim basis this application, effective the date of this Order. The Commission also ratifies, pursuant to subsection 25(4) of the Act for the period between 1 June 2006 and the date of this Order, the charging of the rates as set out in the expired tariff.
