Licence amendment to Class 1 regional licence for its cable broadcasting distribution undertaking in Newfoundland and Labrador only

1. The Commission approves the application by Bell Aliant Regional Communications Inc., the general partner, as well as limited partner with Bell Canada and 6583458 Canada Inc. (the limited partners), carrying on business as Bell Aliant Regional Communications Limited Partnership, to amend the Class 1 regional broadcasting licence, specifically for its cable broadcasting distribution undertaking (BDU) serving St. John's, Paradise and Mount Pearl, Newfoundland and Labrador, by deleting the following condition of licence:
 

The licensee must distribute the ASN service in accordance with the terms of an agreement between ASN and Newfoundland Broadcasting Limited (NTV), whereby commercial messages that are likely to have a negative impact on NTV be deleted from the ASN service.

2. In New regulatory framework for broadcasting distribution undertakings, Public Notice CRTC 1997-25, 11 March 1997, the Commission set out its new policy framework for BDUs with respect to regional licences and indicated that its policy was intended to ensure that ".holders of regional licences operate pursuant to regulatory requirements comparable to those that apply to the existing cable licensees with whom they compete."
3. The licensee noted that, in Class 1 regional licence for broadcasting distribution undertakings in New Brunswick and in Newfoundland and Labrador, Broadcasting Decision CRTC 2006-459, 31 August 2006, the Commission deleted the above-noted condition of licence from Rogers Cable Communications Inc.'s Class 1 regional licence for its cable BDU serving St. John's and surrounding area, Newfoundland and Labrador.
4. The Commission received one intervention in support of this application.
