CHRI-FM Ottawa and its transmitters - Licence renewal

1.

The Commission renews the broadcasting licence for the specialty radio programming undertaking CHRI-FM Ottawa and its transmitters CHRI-FM-1 Cornwall and CHRI-FM-2 Pembroke, from 1 September 2005 to 31 August 2012.

The Commission received interventions in support of this application.

The Commission reminds the licensee of the requirements set out in the Religious Broadcasting Policy, Public Notice CRTC 1993-78, 3 June 1993, with respect to balance and other matters involving broadcasting of religious programming as well as soliciting funds.

The licensee is a not-for-profit corporation and accordingly is not a commercial station as defined in the Radio Regulations, 1986. The licence will, however, be subject to conditions of licence numbers 1, 3, 4, 6 and 7 set out in New licence form for commercial radio stations, Public Notice CRTC 1999-137, 24 August 1999, as well as to the following conditions of licence:
 
  • The station shall be operated within the Specialty format as defined in A Review of Certain Matters Concerning Radio, Public Notice CRTC 1995-60, 21 April 1995, as amended from time to time.
 
  • During each broadcast week, a minimum of 80% of all musical selections broadcast shall be drawn from subcategory 35 (non-classic religious).
 
  • All programming drawn from subcategory 11 (News) must be broadcast in the English language and a maximum of 10% of programming from subcategory 12 (Spoken Word - Other) may be broadcast in the French language.
 
  • During each broadcast week, a minimum of 12% of all musical selections drawn from category 3 (Special Interest Music) must be Canadian.
 
  • During each broadcast week, a minimum of 10% of all musical selections broadcast during ethnic program periods must be Canadian.
 
  • During each broadcast week, all advertising material shall be broadcast in the English language, with the exception of a maximum of 15 minutes of French-language advertising.
 
  • During each broadcast week, the licensee shall broadcast a maximum of 20% hit material as defined in Revised policy on the use of hits by English-language FM radio stations, Public Notice CRTC 1997-42, 23 April 1997, as amended from time to time.
 
  • During each broadcast year, the licensee shall devote $13,000 in direct expenditures to support the development of Canadian talent.

The Commission notes that the Cornwall and Pembroke transmitters authorized in CHRI-FM Ottawa - New transmitter in Cornwall, Broadcasting Decision CRTC 2004-547, 14 December 2004 (Decision 2004-547) and CHRI-FM Ottawa - New transmitter in Pembroke, Broadcasting Decision CRTC 2005-118, 31 March 2005 (Decision 2005-118) respectively, are not yet in operation, and that the Department of Industry (the Department) has advised the Commission that, while the applications with respect to the Cornwall and Pembroke transmitters are conditionally technically acceptable, it will only issue broadcasting certificates when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, the authorities for the Cornwall and Pembroke transmitters will only be effective when the Department notifies the Commission that its technical requirements have been met, and that broadcasting certificates will be issued.

The Cornwall transmitter must be operational at the earliest possible date and in any event no later than 24 months from the date of Decision 2004-547, unless a request for an extension of time is approved by the Commission before 14 December 2006. In order to ensure that such a request is processed in a timely manner, it should be submitted in writing at least 60 days before that date.

8.

The Pembroke transmitter must be operational at the earliest possible date and in any event no later than 24 months from the date of Decision 2005-118, unless a request for an extension of time is approved by the Commission before 31 March 2007. In order to ensure that such a request is processed in a timely manner, it should be submitted in writing at least 60 days before that date.
