Call for comments on a request by the CCTA for the addition of HD Net and Discovery HD Theater to the lists of satellite services eligible for digital distribution

 

Extension of deadline for submission of comments

In Call for comments on a request by the CCTA for the addition of HD Net and Discovery HD Theater to the lists of satellite services eligible for digital distribution, Broadcasting Public Notice CRTC 2004-61, 10 August 2004 (Public Notice 2004-61), the Commission invited comments on a request by the Canadian Cable Telecommunications Association (CCTA) to add two high definition (HD) non-Canadian satellite services, HDNet and Discovery HD Theater, to the lists of satellite services eligible for digital distribution (the digital lists). The Commission established a deadline of 5 November 2004 for the filing of comments, followed by written replies from the CCTA no later than 19 November 2004.

The Commission encouraged parties filing comments concerning the CCTA's request to take into account the proceeding initiated by Call for comments on a proposed framework for the licensing and distribution of high definition pay and specialty services, Broadcasting Public Notice CRTC 2004-58, 6 August 2004 (Public Notice 2004-58), including additional questions related to the migration of pay and specialty services to a digital distribution environment to be set out in a second public notice (the migration notice).

By letter dated 4 October 2004, the CCTA requested that the Commission extend the deadline for the filing of comments with regard to Public Notice 2004-58, noting among other things that the Commission had not yet issued the migration notice.

In comments dated 14 October 2004 supporting the CCTA's request for an extension, CTV Inc. (CTV) also requested an extension of the deadline to submit comments on the CCTA's request to add the above-noted non-Canadian satellite services to the digital lists. CTV requested that the Commission extend the deadline for comments until at least 90 days following the release of the migration notice. On 19 October 2004, the CCTA filed comments opposing CTV's request, arguing among other things that consideration of the issues raised in Public Notice 2004-61 can, and should, proceed independently of the Commission's review relating to the broader licensing and distribution framework for HD pay and specialty services.

In Broadcasting Public Notice CRTC 2004-58-1 issued today, the Commission extended the deadline for the submission of comments with respect to its proposed framework to 7 February 2005.

Having considered the submissions, the Commission extends the deadline for the filing of comments with respect to Public Notice 2004-61 to 7 February 2005. The CCTA may file written replies to any comments no later than 21 February 2005.
