Broadcasting Public Notice CRTC 2004-44

  The Commission has received the following application. The deadline for submission of interventions/comments is 13 August 2004.

Application No. 2004-0038-3
  Application by W Network Inc. (previously known as Lifestyle Television 1994 Limited) to amend the licence of the specialty programming undertaking.
  The licensee proposes to change its condition of licence no. 3(a), set out in Decision CRTC 2001-151, relating to Canadian programming expenditures, which reads:
  In each broadcast year, the licensee shall expend on Canadian programs not less than 41% of the previous broadcast year's gross revenues.
  The proposed condition of licence would read as follows:
  In each broadcast year, the licensee shall expend on Canadian programs, on a cash basis, not less than 41% of the previous broadcast year's gross revenues.
  W Network states that from the time it was first licensed by the Commission in 1994, it has calculated its Canadian programming expenditures on an accrual basis. W Network is now requesting authorization to account for these expenditures on a cash basis, over the current licence term, from March 1, 2001 to August 31, 2007.
  W Network requests this change in order to align the management of its financial and regulatory reporting with the same reporting methods used by three of its other services, YTV Canada, Inc., Movie Central Ltd. and Encore Avenue Ltd., which all report their respective Canadian programming expenditures on a cash basis. W Network concludes that this change would have no negative impact on the level of cash expenditures on Canadian programming.
