ExaTEL Inc.

  Reference: Tariff Notices 5 and 5A

The Commission received an application by ExaTEL Inc. (ExaTEL), dated 14 November 2003 and amended on 16 January 2004, to revise the following General Tariff items in:
 
  • Part B, Interconnection with Local Exchange Carriers

- item 201, Compensation for Traffic Termination

 
  •  Part C, Interconnection with Interexchange Service Providers (IXSPs)

- item 302, Trunk-side Access

- item 303, Network Announcements for Customers of Disconnected IXSPs with Trunk-side Access

- item 304, Bulk Transfer of End-Customer Base Between IXSPs; and

 
  • Part D, Interconnection with Wireless Service Providers

- item 402, Trunk-side Access

- item 403, Line-side Access

ExaTEL submitted that the proposed tariff pages reflected the revised interconnection rates identified in the Competitive Local Exchange Carrier Model Tariff (Model Tariff), Version 20.

The Commission received comments, dated 12 February 2004, from Aliant Telecom Inc., Bell Canada and MTS Communications Inc. (collectively, the Companies). The Companies submitted that there was a revision to the Billing and Collection Service rates in Version 20 of the Model Tariff. The Companies submitted that ExaTEL should resubmit the tariff page to appropriately reflect the rates.

ExaTEL did not file reply comments.
 

Commission determinations

In Telecom Order CRTC 2003-495, 5 December 2003, the Commission directed ExaTEL to file proposed tariff pages reflecting the lower interconnection rates issued by the incumbent local exchange carriers (ILECs) pursuant to Regulatory framework for second price cap period, Telecom Decision CRTC 2002-34, 30 May 2002, with an effective date of 1 June 2003.

In Local competition, Telecom Decision CRTC 97-8, 1 May 1997, the Commission directed competitive local exchange carriers to file tariffs and to justify any departure there from.

The Commission notes that, as identified by the Companies, there have been rate reductions in the ILECs' rates for Billing and Collection Service effective 1 June 2003, which are reflected in the Model Tariff. ExaTEL did not reflect these rate reductions in its proposed tariff pages. The Commission notes that ExaTEL did not provide any justification for deviating from the rates approved for the ILECs for Billing and Collection Service. Accordingly, the Commission finds that these rates should be reduced to match the ILECs' rates for this service.

In light of the above, the Commission approves on an interim basis, ExaTEL's proposed rates, subject to the company incorporating amendments to item 305, Billing and Collection Service, identified below:
 
  • replace the rate of $0.0314 for "AR returned prior to billing" with $0.0306;
 
  • replace the rate of $0.1046 for "AR billed to an end-customer" with $0.1021; and
 
  • replace the rate of $4.89 for "AR returned or charged back to IXSP after billing" with $4.78.

The proposed rates take effect as of 1 June 2003. The Commission directs ExaTEL to issue forthwith revised tariff pages reflecting the changes specified above.
