Use of 102.5 MHz by CJFX-FM Antigonish's new transmitter in Inverness

1.

The Commission approves the application by Atlantic Broadcasters Limited (Atlantic) to operate its new transmitter of CJFX-FM Antigonish in Inverness at 102.5 MHz (channel 273B) with an effective radiated power of 2,330 watts.

Atlantic filed the present application in response to the Commission's direction set out in CJFX-FM Antigonish - New transmitter in Inverness, Broadcasting Decision CRTC 2004-138, 8 April 2004 (Decision 2004-138). Atlantic had originally proposed to operate the Inverness transmitter at 97.5 MHz (channel 248B). In Decision 2004-138, the Commission found that the technical parameters proposed in Atlantic's original application conflicted with the FM channel proposed by the Canadian Broadcasting Corporation in its Long Range Radio Plan to implement its Radio Two service in Inverness. Accordingly, the Commission directed Atlantic to submit an application proposing the use of another FM frequency that would be acceptable to both the Commission and to the Department of Industry (the Department).

The Commission did not receive any interventions in connection with the present application.

The Department has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, this authority will only be effective when the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

The transmitter must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 12 November 2006. In order to ensure that such a request is processed in a timely manner, it should be submitted in writing at least 60 days before this date.
