CFMV-FM Pabos Mills - Technical change

  The Commission approves the application to change the frequency of CFMV-FM Pabos Mills, from 95.5 MHz (channel 238LP) to 92.1 MHz (channel 221LP).
 

The application

The Commission received an application by Radio du Golfe inc. (Radio du Golfe) to amend the broadcasting licence for the radio programming undertaking CJMC-FM Sainte-Anne-des-Monts, Quebec. The licensee proposed to amend the licence by changing the frequency of its transmitter CFMV-FM Pabos Mills, from 95.5 MHz (channel 238LP) to 92.1 MHz (channel 221LP).
 

Interventions

The Commission received two interventions, one by Diffusion Communautaire Baie-des-Chaleurs inc. (Diffusion Communautaire), the licensee of CIEU-FM Carleton, Quebec, and the other by Radio CHNC ltée (Radio CHNC), the licensee of CHNC New Carlisle, Quebec.

Diffusion Communautaire stated that it does not object to the present application, provided that it concerns only the proposed change in frequency for CFMV-FM. Diffusion Communautaire pointed out that this application could be confused with another application by Radio du Golfe scheduled for the 16 February 2004 hearing in Québec, to which Diffusion Communautaire is opposed. In the second application, Radio du Golfe is seeking to obtain a broadcasting licence to operate a new French-language commercial FM radio station in Pabos (formerly Chandler) as well as a transmitter in New Carlisle. If the latter application is approved, Radio du Golfe will also propose to amend the licence of CJMC-FM in order to delete the transmitter at Pabos Mills.

In its intervention, Radio CHNC also pointed out the possible confusion between the application by Radio du Golfe to change the frequency of CFMV-FM and its second application scheduled for the 16 February 2004 hearing. Radio CHNC stated that it is opposed to the application by Radio du Golfe scheduled for the 16 February 2004 hearing, but does not oppose the application to change the frequency of CFMV-FM.

Radio du Golfe did not respond to these interventions.
 

The Commission's analysis and determination

As indicated in Broadcasting Public Notice CRTC 2003-62, the present application by Radio du Golfe involves only changing the frequency of CFMV-FM Pabos Mills.

The Commission notes that the two interveners do not oppose the present application, but rather the application by Radio du Golfe scheduled for the 16 February 2004 hearing. The latter application will be the subject of another decision that will be published at a later date and that will take into consideration the related interventions, including those of Diffusion Communautaire and Radio CHNC.

Consequently, the Commission approves the application by Radio du Golfe inc. to amend the broadcasting licence for CJMC-FM Sainte-Anne-des-Monts in order to change the frequency of its transmitter CFMV-FM Pabos Mills, from 95.5 MHz (channel 238LP) to 92.1 MHz (channel 221LP).

The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will issue a broadcasting certificate only when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, this authority will only be effective when the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

Given that the technical parameters approved in this decision are for a low-power unprotected FM service, the Commission also reminds the licensee that it will have to select another frequency if the Department so requires.
