Revised lists of eligible satellite services

  The Commission is making revisions to its Lists of Eligible Satellite Services. The four lists appended to this public notice supersede the lists appended to Revised lists of eligible satellite services, Broadcasting Public Notice CRTC 2002-9, 18 February 2002.
 

Addition of Saskatchewan Communications Network Corporation to the List of Part 2 Eligible Satellite Services, and the List of Part 3 Eligible Satellite Services

In Saskatchewan Communications Network Corporation, Decision CRTC 91-98, 14 February 1991, the Commission approved an application by Saskatchewan Communications Network Corporation (SCN) to operate a non-commercial English-language television network in Regina, Saskatchewan, for the distribution of educational programming via satellite. The service is known as CSCN-TV. Pursuant to section 17 of the Broadcasting Distribution Regulations, Class 1 and 2 distribution undertakings in Saskatchewan must distribute CSCN-TV as part of their basic service.

In Call for comments on a request to add Saskatchewan Communications Network Corporation (SCN) to the lists of eligible satellite services, Broadcasting Public Notice CRTC 2003-4, 6 February 2003, the Commission requested comments on SCN's proposal that CSCN-TV be added to the List of Part 2 Eligible Satellite Services and the List of Part 3 Eligible Satellite Services (the Part 2 and Part 3 lists).

The Commission notes that no comments were filed with respect to SCN's request. It also notes that all other Canadian provincial educational television services are eligible for distribution under both the Part 2 and Part 3 lists.

Accordingly, the Commission is adding CSCN-TV to the Part 2 and Part 3 lists. As a result, Class 1 and 2 distribution undertakings located outside of Saskatchewan may distribute CSCN-TV at their discretion, without prior Commission approval. Further, all Class 3 distribution undertakings located throughout Canada may distribute CSCN-TV either as part of the basic service or on a discretionary tier, without prior Commission approval, provided that SCN does not object to such distribution.
 

Change of name for Muzzik

In Revised Lists of Eligible Satellite Services, Public Notice CRTC 2001-82, 13 July 2001, the Commission added the non-Canadian French-language music service known as Muzzik to the List of Part 2, Part 3 and DTH Eligible Satellite Services for Digital Distribution (the Part 2, Part 3 and DTH list for digital distribution).

In a letter from Bell ExpressVu Inc., the general partner, and BCE Inc. and 4119649 Canada Inc. (Partners in BCE Holdings G.P.), the limited partners, carrying on business as Bell ExpressVu Limited Partnership (ExpressVu), the Commission was informed that the service previously known as Muzzik has changed ownership and been renamed Mezzo. ExpressVu proposed that the Commission revise the Part 2, Part 3 and DTH list for digital distribution to reflect Muzzik's change of name, since the service is already approved for distribution in Canada.

In support of its proposal, ExpressVu filed documentation obtained from Mezzo, including:
 
  • a programming schedule for Mezzo;
 
  • a letter from the Président Directeur Général of Mezzo stating that Mezzo is substantially similar to Muzzik;
 
  • a copy of the Muzzik French broadcasting licence amendment signed by the French Audiovisual Regulatory Body at the time of the transformation of Muzzik to Mezzo, which states that Muzzik is simply "substituted" by Mezzo.

Based on the supporting documentation, the Commission is satisfied that Mezzo has undergone a name change only. Accordingly, the Commission has amended the Part 2, Part 3 and DTH list for digital distribution to reflect the change of name from Muzzik to Mezzo.

The Part 2 and Part 3 lists, as well as the Part 2, Part 3 and DTH list for digital distribution are attached to this notice as Appendices A, B and D respectively. The list of DTH Eligible Satellite Services, while not amended, is attached as Appendix C for convenience.
